Only bidders who have the required suitability for the fulfillment of the contractual obligations (technical knowledge and efficiency) are eligible for the contract (-- 122 GWB, -44, 45, 46 VgV), and not acc. -- 123, 124 GWB are to be excluded (see also Section III, No. 1.2). In deciding on the award, various criteria justified by the subject-matter of the contract are taken into account (- 58 (2) VgV (see Section II No. 2.5). The contract will be awarded on the basis of the most economical offer, taking into account all circumstances; the lowest-Quotation price alone is not decisive (- 127 GWB).
