Two-year maintenance service for lifting equipment and trolleys, divided into 9 lots

Two-year maintenance service for lifting equipment and trolleys at Trenitalia IMC AV Naples, IMC AV Milan, IMC AV Rome, IMC Milan, IMC Rome, DPR Sicily, IMC Bari, DPR Lazio, DPR Sardinia and possibility of possible preorganization for a further 12 months, divided into 9 separate lots:

Main Site: Naples.

Two-year trolley maintenance service at the IMC AV Napoli plant and possibility of a possible 12-month extension.

The economic operator and any auxiliary company must be in possession of the following general requirements pursuant to art. 80 of Legislative Decree 50 / 2016.

1) pursuant to art.89, paragraph 4, of Legislative Decree 50/2016, recourse to the institution of the recovery is not allowed for the following requirements: UNI EN ISO 9001 and 14001;

2) PM;

4) Trenitalia will carry out the verification the actual existence of the requirements referred to in paragraph III.1 above with respect to the best bidder; in the event of a negative outcome, Trenitalia will proceed with its exclusion from the tender, at incameramento of the provisional deposit as well as reporting to the ANAC and the awarding in favor of the first of the following competitors in the ranking, subjected to checks with positive outcome;

5) Trenitalia reserves the right to carry out the verification of the actual existence of the requirements of in the previous paragraph III.1, also by sampling, towards other bidders. In case of exnegative, Trenitalia will proceed with their exclusion from the tender, the forfeiture of the provisional deposit and the report to the ANAC;

6) Trenitalia reserves the right to proceed with the verification and possible exclusion of abnormally low tenders pursuant to art. 97 of Legislative Decree 50/2016;

7) Trenitalia reserves the right to interrupt or cancel the race based at any timeto evaluations of its own exclusive competence without the competitors having any rights or expectations of any kind;

8) Trenitalia reserves the right to proceed with the award even in the presence of only one valid offer;

9) Trenitalia reserves the right, in the event of termination of the contract due to default by the contractor, or its failure, to call the second classified in order to sthypect a new contract for the continuation of the services, at the same conditions already proposed in the offer; the above until the list of validly formulated offers has been exhausted;the last three years:

i) in the resolution for non-fulfillment of works contracts, services and supplies entrusted by contracting stations of Trenitalia or of other companies of the FSI group;

ii) in the failure to take delivery of works, supplies or services entrusted by Trenitalia or another company of the FSI group, on its own behalf and through fault;

iii) in the declared non-test of works, sservices and supplies covered by a contract stipulated with Trenitalia or another company of the FSI group;

iv) in the violation, during the execution of previous contracts or during the participation in previous tender procedures, of one of the rules contained in the Code of Ethics of the FSI group, ascertained by any means of proof by Trenitalia;

11 ) Trenitalia reserves the right toexclude offers submitted by RTIs made up of 2 or more economic operators that individually possess the financial and technical requirements for participation if an analysis of the structure and dynamics of the market concerned or of any other element reveals a precise anti-competitive desire of the companies involved;

13) this announcement and published in GUUE, GURI, on the siteof the Ministry of Infrastructure and Transport www.serviziocontrattipubblici.it, on www.acquistionline.trenitalia.it and on the newspapers: La Repubblica and Il Corriere della Sera;

15) pursuant to the combined provisions of paragraph 2, lett. a), and paragraph 5, lett. a), of the art. 4, of Legislative Decree 231/2002 as amended by Legislative Decree 192/2012, the payment terms for the fees are set in60 days from the receipt of the invoice

16) the contract that regulates the contract object of the present procedure will not contain the arbitration clause; staff and marketing.
