Supply of n. 44 electric trucks complete with trailers equipped for emptying the rolling stock retreats of the fleet of the T regional passenger divisionrenitalia S.p.A., in option the supply of additional n. 29 trolleys of the same type, and possible supply of spare parts.

Supply of n. 44 electric trolleys complete with trailers equipped for the emptying of the rolling stock retreats of the fleet of the regional Passenger Division of Trenitalia S.p.A. and in option the supply of additional n. 29 carts of the sameto type, and possible supply of spare parts.

The economic operator and any auxiliary company must be in possession of the following general requisites pursuant to art. 80 of Legislative Decree 50 / 2016.

1) Ex art. 89, c. 4, Legislative Decree 50/2016, the benefit is not allowed for: certification of its management system for quality in accordance with ISO 9001: 2015;

2) Trenitalia S.p.A. will carry out the verification of the actual existence of the requirements referred to in the previous paragraph III.1) towards the best bidder. In the event of a negative outcome, Trenitalia S.p.A. will proceed to its exclusion from the tender, to the forfeiture of the provisional deposit as well as to the notification to the ANAC and to the awarding in favor of the first of the following competitors in the rankingsa, subjected to checks with positive results;

3) Trenitalia S.p.A. reserves the right to carry out the verification of the actual existence of the requisites pursuant to the previous paragraph III.1), also on a sample basis, towards other bidders. In the event of a negative outcome, Trenitalia S.p.A. proceed to their exclusion from the tender, to the forfeiture of the provisional bail and to the report to the ANAC;

4) Trenitalia S.p.A. reserves the right to proceed with the verification and possible exclusion of abnormally low tenders pursuant to art. 97, Legislative Decree 50/2016;

5) Trenitalia S.p.A. reserves the right to interrupt or cancel the race at any time on the basis of assessments of its own exclusive competence without the competitors having any rights or expectations;

6) TrenitaliaS.p.A. reserves the right to proceed with the award even in the presence of only one valid offer;

7) Trenitalia S.p.A. reserves the right, in the event of termination of the contract due to default by the assignee, or its failure, to call the second classified in order to enter into a new contract for the continuation of the services, at the same conditions already proposed at the time of the offer. The above up to exhaustion of the list of validly formulated offers;

8) Trenitalia S.p.A. reserves the right to exclude competitors for whom, according to their own motivated assessment, there is no adequate professional reliability as they are incurred in the last three years:

i) in the resolution for non-fulfillment of contracts for works, services and suppliesdata from contracting stations of Trenitalia S.p.A. or of other companies of the FSI group;

ii) in the failure to take delivery of works, supplies or services entrusted by Trenitalia S.p.A. or by another company of the FSI group;

iii) in the declared non-test of works, services and supplies covered by a contract stipulated with Trenitalia S.p.A. or other group companyFSI;

iv) in the violation, during the execution of previous contracts or during participation in previous tender procedures, of one of the rules contained in the FSI group`s code of ethics, ascertained by any means of proof by Trenitalia SpA ;

9) Trenitalia SpA reserves the right to exclude offers presented by RTIs made up of 2 or more economic operators chand individually they possess the financial and technical requisites for the participation if from an analysis of the structure and dynamics of the market concerned or from any other element, it detects a precise anticompetitive will of the companies involved; GURI, on the website of the Ministry of Infrastructure and Transport www.serviziocontrattipubblici.it, on www.acquistionline.trenitalia.it and on the newspapers: La Repubblica, Il Corriere della sera;

11) pursuant to the combined provisions of paragraphs 2, lett. a) and 5, lett. a) of the art. 4, Legislative Decree 231/2002 as amended by Legislative Decree 192/2012, the terms of payment of the fees are set in 60 days from receipt of the invoice;

12) the contract that regulates the contract subject to the presprocedure does not contain the arbitration clause;

13) the person in charge of the procedure of this tender procedure and the manager of the Purchasing Department - industrial, staff and marketing purchases.
