Conclusion of a non-exclusive discount agreement according to - 130a Abs. 8 SGB V on the active substance gefitinib, ATC L01xE02, for the period 1.7.2019 - 30.6.2021

- 130a Abs. 8 SGB V allows the health insurance companies and pharmaceutical companies, framework discount contracts on the to be paid to the statutory health insurance Arzto close down. In view of the pertinent legal regulations for the awarding of public contracts, a regular process of active substance-related, public procurement procedures takes place according to the regulations of the 4th part of the GWB by the DAK-G. For the medicinal product to be designated by the tenderer in Annex 2 to the contract concerning the active substance gefitinib, ATC L01xE02, approxDAK-G plans to conclude a drug discount agreement with as many pharmaceutical companies as possible, pending the entry into force of new drug rebates. A discount contract within the scope of the approval model for the o. G. Active ingredient will enter into force on 1.7.2019 and will end on 30.6.2021. It automatically ends independently with the entry into force of the exclusive contract.

Tuee DAK-Health ("DAK-G") assumes that this procedure does not fall within the scope of antitrust law due to a lack of selection decision and thus non-discriminatory accessibility of all pharmaceutical companies, and automatically ends with the entry into force of the exclusive agreement with Gefitinib, ATC L01xE02, as a result of a formalAward procedure according to the regulations of the 4th part of the GWB with one or more contractual partners. In order to meet the diversity of potential contractors within the scope of the approval model, each pharmaceutical company will be able to conclude a framework contract at any time and under the same conditions during the contract period. The required contractDocuments are available for download via the online portal www.dtvp.de/center under the link named under I.3).

Conditions for the conclusion or later accession to the contracts which enter into force on 1.7.2019 is the complete and timely transmission of the following evidence / explanations / attachments (available for download under the L.3 mentioned under I.3)1) Letter of invitation;

2) Current proof of entry in the professional or commercial register (see III.1.1));

3) Self-declaration by the company (Annex A1) that none of the exclusion criteria according to -- 123, 124 GWB exist (see III.1.1)); 4) self-declaration that for those medicines for which the interested partyto conclude a contract under this procedure, to have a drug license and that the bidder is entitled to distribution at the beginning of the contract (Appendix A2) (see III.1.1))

5) self - declaration by the company that the statutory minimum wage requirements and adherence to tariff fidelity (Appendix A3) (see III.1.1).

6) Recognition of contractual obligationsDAK-G stipulations, in particular also the prescribed rebates by signing the contract stamped with a company stamp (twice in the original) by the interested party at the designated place.

7) Attachments 1 and 2 to the contract (2 each in the Original). The interested party has the medicines for the o. G. To enter the active ingredient which is to become the subject of the contract.

Note: DThe publication is done here using the Open Procedure form. As has already been made clear, this is not one - the notice had to be used for technical reasons, as there is no form suitable for approval procedures.

1) Current proof of registration in the professional or commercial register (not older than 6 Months at versein accordance with the legislation of the country in which the company is established, eg B. current commercial register extract; Copy is sufficient.

2) Self-declaration of the company that none of the exclusion criteria according to -- 123, 124 GWB exists. Attachment A1 has to be signed, marked with company stamp and submitted in the original.

3) Self-declaration that fthose medicines for which the prospective buyer wishes to conclude a contract under this procedure, a drug license and that the tenderer is entitled to distribution at the beginning of the contract (Appendix A2) (see III.1.1).

4) Self-declaration by the company that the legal requirements for the minimum wage and the tariff fidelity are observed and adhered to (Annexe A3). Attachment A3 should be signed, accompanied by a company stamp and submitted in original form.

DAK-Gesundheit has published a so-called pre-qualification procedure for pharmaceutical companies for the simplified participation in future drug rebate tenders via the European Announcement Platform (EU Announcement 2015 / S 105- 190319 of 3.6.2015). SIf the bidder has received an effective pre-qualification notification from DAK-Gesundheit in good time before submission of the documents, he needs the company-specific proof of eligibility (proof of entry in the trade or professional register, self-declaration by the company that none of the exclusion criteria according to -- 123, 124 GWB is present, clearance certificate of lawIen Krankenkasse, self-declaration minimum wage and rate loyalty) under reference and enclosing the Praequalifikationsbescheides in copy no longer to be attached. Attachment A2 must always be attached. Accordingly, the DAK health pre-qualification notification also serves as proof of DAK health open-house procedures, regardless of the value of the order.
