Conclusion of a non-exclusive discount agreement according to - 130a Abs. 8 SGB V on the active ingredient Infliximab

130a Abs. 8 SGB V allows the health insurance companies and pharmaceutical companies to conclude framework discounts on the medicines to be paid to the statutory health insurance funds. According to - 130a Abs. 8 S. 5 SGB V hereby the health insurance companies Leistungserbthird parties to conclude such contracts. The GWQ acts as a society for economy and quality with health insurance companies for their Aktionaers and customer funds. In view of the pertinent statutory provisions on the awarding of public contracts, a regular process of active substance-based public procurement procedures according to Regularia of the 4th part of GWB by GWQ ServicePlus AG. Until new drug discount agreements come into force, GWQ would like to conclude drug discount agreements with all interested pharmaceutical companies in the context of the open-house procedure on the active ingredient infliximab.

GWQ ServicePlus AG assumes that this procedure will be terminated due to a lack of selection decisionsand thus the non-discriminatory accessibility of all pharmaceutical companies does not fall within the scope of antitrust law. This discount contract within the scope of the approval model for the o. G. Active substance will enter into force on 1.4.2019 for the first time and will end on 31.3.2021. In order to do justice to the diversity of the contractual partners within the framework of the admission model, every phaduring the contract period, the conclusion of a framework agreement at any time and on the same terms. The contract documents, the participating health insurance companies as well as the dates for the notification of the contract can be viewed and downloaded on the allocation portal of GWQ ServicePlus AG under http://vergabeportal.gwq-serviceplus.de. At the entrance of uSigned contracts on the 10th of each month, a message for the next reporting month can be realized. Upon receipt of the contracts until 10.3.2019, a notification can be made on April 1st, 2019.
