Open procedure with electronic means on behalf of the Municipality of Porcari relating to the maintenance service of green areas and appurtenances of municipal roads. Municipality of Porcari

All economic operators, as well as definished under art. 3, c. 1, lett. p) of Legislative Decree 50/2016, and listed in art. 45, paragraph 2, of Legislative Decree 50 / 2016.

In the event of participation in the tender of temporary groupings of competitors, ordinary consortia, aggregations of network companies or EEIGs, the due clarifications regarding the requirements of professional suitability, economic and financial capacity and technical skillsca and professional

In general, in temporary groupings the agent must, in any case, possess the requisites and perform the services in a majority measure pursuant to art. 83, paragraph 8, of the Code

To the aggregations of companies adhering to the network contract, to the ordinary consortia and to the EEIGs the discipline envisaged for temporary groupings of companies is applied, as it is compatible withile. In ordinary consortia, the consortium member that assumes the largest share of executive activities has the role of leader who must be assimilated to the agent. established or a combination of network companies, the related requirements for participation are metmade according to the same procedures indicated for the groups

With regard to the requirements of professional suitability, (registration in the register kept by the Chamber of Commerce, Industry, Crafts and Agriculture) must be possessed by:

a) each of the companies grouped / grouped, consortium members / consortium or EEIG;

b) each of the companies participating in the network contract indicated as eand by the network itself in the event that it has juridical subjectivity.

With regard to the requirements of economic and financial capacity, they must be satisfied by:

- global turnover: from the temporary grouping as a whole; this requirement must be owned for the majority by the agent,

- specific turnover: from the temporary horizontal grouping in thecomplex; this requirement must be possessed in a majority way by the agent. With regard to the technical and professional capacity requirements, the following must be possessed:

- list of the main services provided in the last three years: by both the agent and the principals; this requirement must be possessed in a majority way by the agent, - - possession of the equipment and mework equipment specified above: both by the agent and by the principals; this requirement must be possessed in a majority way by the agent.

In case of participation in the tender of subjects pursuant to art. 45, c. 2, lett. b) and c) of the Code (consortia between cooperative societies and permanent consortia) the necessary clarifications regarding the requirements of professional suitability are listed below., of economic and financial capacity and of technical and professional capacity. With regard to the requirements of professional suitability, (registration in the register kept by the Chamber of Commerce, Industry, Crafts and Agriculture) it must be owned by the consortium and the associated companies indicated as executors.

Regarding the economic and financial capacity requirements and the requirements of ctechnical and professional apacity, must be possessed:

1) for consortia as per art. 45, paragraph 2, lett. b) of the Code, directly by the consortium itself, except for those relating to the availability of equipment and means of work as well as to the average annual headcount that are counted in the consortium even if owned by the individual member companies;

2) for the consortia referred toll`art. 45, paragraph 2, lett. c) of the Code, by the consortium, which can spend, in addition to its own requirements, also those of the consortium members and, through support, those of the non-executive consortium members, which are calculated cumulatively by the consortium.

Requirements of professional suitability

The economic operator must possess pursuant to art. 83, paragraph 3, of Legislative Decree 50/2016:

a) registration in the Register of the Chamber of Commerce, Industry, Crafts and Agriculture or in the Register of Provincial Craft Commissions, for activities related to the subject of the contract;

b) to the citizen of another Member State not resident in Italy and proof of registration is required, in accordance with the regulations in force in the State of residence, in one of the professional or commercial registerspursuant to Annex XVI of Legislative Decree 50/2016, by sworn declaration, or according to the procedures in force in the Member State in which it is established or by means of a declaration, under its own responsibility, that the certificate produced has been issued by one of professional or commercial registers established in the country in which you reside.

Requirements of economic and financial capacity

I concorrenti, pursuant to art. 83, paragraph 4, and to XVII, part I, of Legislative Decree 50/2016, at the date of publication of the notice and when presenting the tender offer must possess and demonstrate economic and financial capacity.

Requirements of technical and professional capacity

Ai competitors, pursuant to art. 83, paragraph 6, and to XVII, part II, of Legislative Decree 50/2016, on the date of the pubapplication of the notice and at the time of submitting the tender offer must possess and demonstrate the technical and professional capacity.
