Parks maintenance services.

Maintenance service of public green spaces with reduced environmental impact under the D.M. 13.12.2013, in G.U. n. 13 of 17.1.2014.

The offer is accompanied by:

1) a provisional guarantee, as defined by art. 93 of the Code, equal to 2% and specifically an amount equal to EUR 44 957.32., Except as provided for by'Art. 93, paragraph 7 of the Code;

2) a declaration of commitment, by a bank or insurance company or other person pursuant to art. 93, paragraph 3 of the Code, also different from the one that issued the provisional guarantee, to issue a final guarantor guarantee pursuant to article 93, paragraph 8 of the Code, if the tenderer is entrusted. This declaration of commitmentso is not required for micro-enterprises, small and medium-sized enterprises and for temporary groupings or ordinary consortia exclusively from the same ones.

Pursuant to art. 93, paragraph 6 of the Code, the provisional guarantee covers the non-signing of the contract, after the award, due to any fact attributable to the assignee or to the adoption of anti-mafia disqualification information emessa pursuant to articles 84 and 91 of Legislative Decree 6.9.2011, n. 159. Facts relating to the general and special requirements are ascribable to the assignee, among other things; the failure to produce the documentation required and necessary for the conclusion of the contract. Any exclusion from the tender before the award, outside the cases referred to in art. 89 paragraph 1 of the Codeand, it will not involve the enforcement of the provisional guarantee.

The provisional guarantee covers, pursuant to art. 89, paragraph 1 of the Code, also the false declarations made in the context of the transfer.

The provisional and constituted guarantee, at the choice of the competitor:

a. in government-guaranteed public debt securities deposited at a provincial treasury section or at the authorized companiesas a pledge in favor of the contracting authority; the value must be on the day of the deposit;

b. without prejudice to the limit on the use of cash referred to in Article 49, paragraph 1 of Legislative Decree 21.11.2007 no. 231, in cash, by bank transfer, in bank drafts, with payment to the Treasury of the City of Altamura c / o Banca Popolare di Bari IBAN IT55V0542404297000000000288;

c. bank or insurance guarantee issued by banking or insurance companies that meet the requirements of art. 93, paragraph 3 of the Code (registered in the Single Central Commission of the Municipalities of Altamura and Poggiorsini c / o Municipality of Altamura C.F .: 8202590725). In any case, the guaranty guarantee and conforms to the standard scheme as per art. 103, paragraph 9 of the Code-economic operators, before proceeding with the subscription, are required to verify that the guarantor is in possession of the authorization to issue guarantees through access to the following websites:

In case of guarantee performance, this will have:

1 ) contain express mention of the object and of the guaranteed subject (Central Unit of Committees of the Municipalities of Altamura and Poggiorsini c / o Municipality of Altamura CF: 8202590725);

2) be registered in your nameall the economic operators of the constituted / constituting temporary group or ordinary consortium or EEIG, or to all the retired companies participating in the tender or, in the case of consortia pursuant to art. 45, paragraph 2, lett. b) and c) of the Code, to the sole consortium;

3) to conform to the standard scheme approved by the Minister of Economic Development n. 31 of 19.1.2018;

4) to have gonefor 180 days from the deadline for submission of the offer,

5) expressly provide for:

a. the waiver of the benefit of the preventive enforcement of the principal debtor pursuant to art. 1944 of the civil code, wanting and intending to remain jointly and severally obliged with the debtor;

b. the refusal to plead the commencement of the terms set forth in art. 1957 of the civil code;

c. their workwithin fifteen days at the simple written request of the contracting authority;

6) contain the commitment to release the final guarantee, if issued by the same guarantor;

It can not be remedied - and therefore the cause of exclusion - the signing of the provisional guarantee by a person who is not entitled to release the guarantee or not authorized to commit the guarantoro must constitute a final guarantor guarantee pursuant to Legislative Decree No. 50/2016, art. 93 paragraph 8 of the Code.

The contract is financed by Fondi Bilancio comunale (V PCF level 1.03.02.01.07.012 chapter 834009 and 1.03.02.99.999 chapter 834005)

The economic operators for which there are causes are excluded from the tender exclusion pursuant to art. 80 of the Code.

Operators are excludedthat have entrusted tasks in violation of art. 53, paragraph 16-ter, of Legislative Decree no. 2001 n. 165.

Economic operators having their seat, residence or domicile in the countries included in the c.d. black list as per the Decree of the Minister of Finance of 4.5.1999 and the decree of the Minister of Economy and Finance of 21.11.2001 must, under penalty of exclusion from the tender, be in possession, deThe authorization in progress of validity issued pursuant to d. December 14, 2010 of the Ministry of Economy and Finance pursuant to Article 37 of Legislative Decree No. 3.5.2010 No. 78 in Law No. 122/2010) or of the application for authorization presented pursuant to art. 1 paragraph 3 of the Ministerial Decree of 14.12.2010.

The non-acceptance of the clauses contained in the pact of integrity constitutes a cause of exclusion from the-tender, pursuant to art. 1, paragraph 17 of Law 190 / 2012.

Eligibility requirements

a) Registration in the register kept by the Chamber of Commerce, Industry, Crafts and Agriculture or in the register of provincial commissions for crafts for activities consistent with those covered by this procedure of competition.

The competitor not established in Italy but in another Member State or in one of the Paesi of the art. 83, paragraph 3 of the Code, submits a sworn statement or according to the procedures in force in the State in which it is established. * For the proof of the requirement the contracting authority acquires the documents of public administrations ex officio, upon indication, by the economic operator, of the indispensable elements for obtaining information or datarequired.
