Open procedure tender, fully managed with telematic systems, for the assignment of natural gas supply, including connection services, at Trenitalia S.p.A. and its servicescommercials

Main Site: Entire National territory

Supply of natural gas, including connection services, at Trenitalia S.p.A. for about n. 101 Redelivery Points (PdR) distributed throughout Italy and the provision of related commercial services. Estimated annual quantity: 19, 000, 000 Smc.

The economic operator and any auxiliary companyiliaria and any subcontractors must be in possession of the general requirements as per art. 80 of Legislative Decree 50/2016

2) Trenitalia will verify the actual existence of the requirements set out in paragraph III.1 above with regard to the best bidder. In the event of a negative result, Trenitalia will proceed to its exclusion from the tender, to the forfeiture of the depositand provisional as well as the reporting to the ANAC and the awarding in favor of the first of the competitors who follow in the ranking, submitted to checks with positive result

3) Trenitalia reserves the right to verify the actual existence of the requirements set out in the previous paragraph III.1 also against other bidders. In case of a negative result, Trenitalia will proceed totheir exclusion from the tender, the forfeiture of the provisional deposit and the reporting to the ANAC

4) Trenitalia reserves the right to proceed, prior to the award, to the verification and possible exclusion of abnormally low tenders as per art. 97 D.Lgs. 50/2016

5) Trenitalia reserves the right to interrupt or cancel the race at any time based on evaluations of its own exclusive competencewithout the competitors having rights or expectations of any kind

6) Trenitalia reserves the right to proceed with the awarding even in the presence of only one valid offer

7) Trenitalia reserves the right, in case of termination of the contract due to non-fulfillment of the assignee; of his failure, to question the second classified in order to stipulate a new contract for the continuationof the services, under the same conditions already proposed at the time of the offer. A similar faculty Trenitalia reserves itself in the event of bankruptcy, resolution or waiver of the second. The above until the list of validly formulated offers is exhausted

8) Trenitalia reserves the right to exclude competitors for whom, according to their own reasoned assessment, there is no adequate reliabilitya professional inasmuch as they have been incurred in the last three years

i) in the resolution for non-fulfillment of contracts for works, services and supplies entrusted by contracting stations of Trenitalia or other companies of the FSI Group;

ii) in the failure to take delivery, by own fact or fault, of works, supplies or services entrusted by Trenitalia or other FSI Group Company;

Iii)in the declared non-testing of works, services and supplies covered by a contract stipulated with Trenitalia or other FSI Group Company;

iv) in the violation, during the execution of previous contracts or on the occasion of participation in previous tender procedures, of one of the rules contained in the FSI Group Code of Ethics, ascertained by any means of proof fromTrenitalia's art

9) Trenitalia reserves the right to exclude offers presented by RTI made up of 2 or more economic operators that individually possess the financial and technical requirements for participation if an analysis of the structure and dynamics of the market concerned or any another element, detects a precise anticompetitive will of the companies involved

11) The takenpublished in GUUE, GURI, on the website of the Ministry of Infrastructures and Transport www.serviziocontrattipubblici.it, on www.acquistionline.trenitalia.it and on the newspapers: La Repubblica, Il Corriere della Sera.

14) The contract which regulates the contract subject of this procedure does not contain the arbitration clause
