Open procedure for awarding development, maintenance and technical assistance services for the Lombardy Region e-Procurement Platform - ARCA_2019_109.1

The contract, divided into 2 (two) lots, concerns the stipulation of two contracts for the supply dsoftware development services for managing technological aspects of functional safety and technological innovation and evolutionary maintenance on e-Procurement platforms and technical assistance services for the management of application services and testing of e-Procurement systems.

The contract relates to the stipulation of a contractor for the supply of software development services for the management of technological aspects of functional safety and technological innovation and evolutionary maintenance on e-Procurement platforms.

Pena exclusion from the tender as essential elements of the offer, each competitor must satisfy, also in accordance with the provisions of the Tender Regulations, the following conditions:

a) registration for activities related to the subject of this contract by C.C.I.A.A. or in the register of provincial commissions for crafts in compliance with the provisions of paragraph 3 of art. 83 of Legislative Decree 50/2016;

b) non-existence of the reasons for exclusion pursuant to art. 80, Legislative Decree no. 50/2016 (in the case of R.T.I. or Consortia, see the provisions of the Tender Regulations).

Penathe exclusion from the procedure as an essential element of the offer, each competitor (in the case of RTIs or Consortia) must satisfy the following condition: having achieved a total turnover in the last 3 financial years (2015, 2016 and 2017) VAT excluded, at least equal to the total value based on the starting price of the Lotto / in which you participate.

1) The tender procedure and geswith the Telematic System called Sintel, accessible from the website www.arca.regione.lombardia.it, whose description and method of use for the purpose of presenting the offer is specified in the Tender Regulations and in the relative Annex as well as in the technical manuals available on the website www.arca.regione.lombardia.it.

2) The specific provisions concerning the supply and the connected servicesyes, the methods of presentation and the elements for evaluating the offers, the unit auction bases that cannot be overcome at the time of the offer, under penalty of exclusion from the tender, the subcontract, the additional causes of exclusion and the other tender information are contained in Tender regulations and related attachments.

3) The modalities of participation in case of temporary grouping of companies, in the case ofaggregations between companies adhering to the network contract, and in the case of a consortium they are regulated in the Tender Regulations.

4) Participation by competitors who are in one of the control situations referred to in art. 2359 of the civil code or in any relationship, even de facto, if the control situation or the relationship:

i) involves that the offers areattributable to a single decision-making center,

ii) has influenced the formulation of the offer. Competitors for whom it is ascertained that the relative offers are attributable to a single decision-making center, based on univocal elements, will also be excluded from the tender.

5) Partial and / or conditional bids are not admitted as specified also in the Tender Regulations and Attachments.

6) I concorrents, with the presentation of the offers, allow the processing of personal data, also personal, pursuant to EU Regulation 2016/679, for insolvency and contractual requirements.

7) Information and clarifications on the tender documents can be requested according to the methods indicated in the Tender Regulations, within and no later than the 16:00 deadline of 29.4.2019. The clarifications in the proceedings dthe bids will be announced / published in the manner specified in the Tender Regulations.

8) The competitors are required to indicate, at the time of submitting the offer, the elected domicile for sending notices acknowledging that they will be sent by sent by ARCA S.p.A. with the methods indicated in the aforementioned annex.

9) The contracting authority reserves the right not to award the contract'contract if, in its unquestionable judgment, no offer is convenient or suitable in relation to the object of the contract, pursuant to art. 95. paragraph 12 of Legislative Decree 50/2016.

11) In the contract outline the electronic ordering methods will be indicated and the invoicing regulatedelectronic payment and electronic payment.

12) Subcontracting is allowed within the limits set by art. 105 of Legislative Decree 50/2016 with the obligation to indicate the provisions of paragraph 6 of the aforementioned art. 105 at the offer submission stage. 13) The possibility of increases or decreases in contractual services up to one fifth of the maximum amount is permitted againsttual to the same terms, prices and conditions of the same.

14) Participation in this procedure is permitted for one or more lots thereof.

15) The Selection Committee pursuant to art. 77 Legislative Decree 50/2016 will consist of a number of commissioners equal to 3.
