The contract pursuant to art. 1 paragraph 4 of L.R. n. 33/2007, has as its object the assignment of the insurance coverage service for the risks of civil liability towards third parties and towards lendWorkers in favor of the following bodies:

Main Site: ASST Cremona.

Competition for the assignment of the insurance coverage of the risks of civil liability towards third parties and to contractors. IX in favor of ASST Cremona.

Pena exclusion from the tender as essential elements of the offer, each competitor must satisfy, also in accordance with the provisions of the Discipliof the tender, the following conditions:

a) registration for activities concerning the subject of this contract in the C.C.I.A.A. o in the register of the provincial commissions for the craft in accordance with the provisions of paragraph 3 of the art. 83 of Legislative Decree 50/2016;

b) there are no grounds for exclusion pursuant to art. 80 of Legislative Decree no. 50/2016 (in the case of R.T.I. or consortiums, see what has been establishedin the Disciplinare di gara);

c) possession of the authorization to exercise insurance activities, in the national territory, in the risk branch subject of the present tender pursuant to Legislative Decree no. 209/2005 and subsequent amendments and supplementary documentation for companies of other U.E. State;

d) possession of a stock exchange listing or, alternatively, possession of a S ratingand issued by another listed rating agency, by way of example but not limited to Moody's Baa, Fitch Rating BBB) or alternatively, possession of an equivalent documentation certifying a level of financial solvency equivalent to or greater than a S ratingaustivo Moody's Baa, Fitch Rating BBB).

In the case of exclusion from the tender as an essential element of the offer, each competitor must satisfy, also in accordance with the provisions of the tender regulations, the following conditions: a value of premiums written (gross), in the last 3 financial years (2017-2016-2015), relating to the non-life business (branch 1)0 RC land vehicles and branch 3 land vehicle bodies) at least equal to the value indicated in the paragraph of the Tender Guidelines (turnover A);

b) have achieved a premium (gross) collection value in the last 3 financial years ( 2017-2016-2015), relating to the insurance coverage of the RCT / O risk in the health and care sector (public or private) at least equal to the valueindicated in the paragraph of the Disciplinare di gara (turnover B).

1) The tender procedure is managed with the telematic system called Sintel, accessible from the website (www.arca.regione.lombardia.it). Description and method of use for the submission of the offer are specified in the specifications of the tender, related attachments and technical manuals available on the website (www.arca.regione.lombardia.it);

2) the attachments to the technical specifications will be provided only upon presentation of a specific request, which must be received according to the procedures indicated in the paragraph of the Competition Regulations, no later than 3:00 pm of 17.7. 2018. For reasons of confidentiality of the information contained therein, the annexes to the technical specifications will not be available for download fromsection on the Sintel platform and from the sites referred to in point I.1);

3) information regarding the service to be assigned; the methods of presentation and the evaluation elements of the offers; the three-year value (gross of government taxes), corresponding to the total auction base that can not be exceeded; the award criteria, subcontracting, uFurther causes for exclusion and other information are contained in the tender regulations and annexes. The contract (policy) that will be stipulated by the institution will have a duration of 36 (thirty-six) months;

4) the modalities of participation in the case of a temporary grouping of companies, aggregations between companies participating in the network contract, co-insurance and consortium are regulated in the Disciplinary of-tender;

5) the participation of competitors who are in one of the control situations pursuant to art. 2359 c.c. or in any relationship, even de facto, if the control situation or the relationship: i) implies that the offers are attributable to a single decision-making center, (ii) has influenced the bid formulation.

Will be excluded from the tender i competefor which it is ascertained that the relative offers are attributable to a single decision-making center, based on unequivocal elements;

6) no partial and / or conditional bids are allowed as specified in the Competition Guidelines;

7) the competitors, with the submission of offers, allow the processing of personal data, also in accordance with Regulation (EU) 2016/679 on the subject of protectionof personal data and of Legislative Decree no. 196/2003 s.m.i., for bankruptcy and contractual requirements;

8) information and clarifications on the tender documents can be requested according to the procedures indicated in the tender regulations, no later than 15:00 on 17.7.2018. The clarifications to the tender documents will be published on the sites referred to in the previous point I.1) with the procedures establishedite in the Disciplinare di gara. For the methods of carrying out the activities of audit and inspection, which may be carried out by each competitor subject to expression of interest that must be received exclusively by means of the Sintel platform function no later than 12 noon on 21.6.2018, please refer to Competition regulations,

9) the competitors must indicate, in the presenof the offer, the domicile elected for the sending of communications, noting that the same will be sent by ARCA with the procedures indicated in the Disciplinary of competition,

10) the contract (policy) that will be stipulated by the institution with the successful bidder does not include the arbitration clause,

11) the sole responsible of the proceedings and Dr Carmen Schweigl;

12) and the subcontract is admittedthe limits of the art. 105 D.Lgs. 50/2016 with the obligation to indicate the provisions of paragraph 6 during the submission of the offer,

13) the jury will be composed of n. 3 experts in the subject matter of the contract,

14) and participation in this procedure for 1 or more lots is allowed
