This call for applications is the procedure pursuant to art. 36 and 60 of Legislative Decree 50/2016 and subsequent amendments, published at European level for the sole purpose of guaranteeing maximum participation, for the conclusion of an agreementframework with a single operator that can be subscribed pursuant to art. 54 of Legislative Decree No. 50/2016 referred to herein as the applicable contractual form relating to the transport service charged to the complete property and technical materials owned by Rai Way SpA. at national level, under all conditions established in the technical specifications and in the framework agreement schema.

Main Site: Entire territory of the countrynal (ITALY - Islands included). The assignment concerns a framework agreement with a single operator for a period of 36 months (without prejudice to the extension option indicated below up to a maximum of a further 12 months) for the service of carriage of the goods and technical materials of Rai Way SpA at national level (including islands).

Economic operators, also established in other Stmembers, can participate in the present competition in single or associated form, according to the provisions of the articles 45, 47 and 48 of Legislative Decree no. 50/2016 and subsequent amendments, provided that they meet the requirements of this call for tenders and the tender regulations. For the participation in the procedure, the operators concerned must be in possession, on the expiration date of the deadline for the presentation of thethe offers, of the requisites indicated below, penalty exclusion from the procedure:

1) absence of causes of exclusion according to the art. 80 of Legislative Decree 50/2016 and subsequent amendments;

2) professional qualification requirements (Article 83, paragraph 1, letter a), of Legislative Decree no. 50/2016 and subsequent amendments:

2.a) registration in the register held by the Chamber of Commerce, Industry, Handicraft and Agriculture or in the register of commissions provinciali for the handicraft for activities coherent with those object of the present competition or for activities of autotrasporto merci third account.

The competitor not established in Italy but in another Member State or in one of the countries of which to the art. 83, paragraph 3 of Legislative Decree No. 50/2016, presents sworn declaration or according to the procedures in force in the State in which it is established;

2.b) registration in the national registerof road haulage contractors on behalf of third parties pursuant to Law 298/74 and s.m.i. for vehicles with unlimited full load (to be considered as adequate registration for all the types of vehicles of which, given what is indicated in the specifications, it is presumed to be able to request the use in progress, which also include vehicles of total mass at full load above 3.5t.) without prejudice to the possession of the necessary authorization from the competent provincial office of the Civil Motorization for vehicles used in the exercise of road haulage activities;

2.c) registration with R.E.N. (National electronic register of companies that exercise the profession of road transport operator), attesting the release by the Motorizzazione civile complicense for the occupation of road haulage operator on behalf of third parties, in the category of vehicles with unlimited laden mass (see above).

The competitor not established in Italy but in another Member State or in one of the countries referred to in art. 83, co. 3 of Legislative Decree No. 50/2016, submits a sworn statement or according to the procedures in force in the State in-which is established;

3) the economic operators must possess, under penalty of exclusion from the tender, the registration to the list of suppliers, service providers and executors of works not subject to attempted mafia infiltration, operating in the sectors most exposed to risk, provided for in paragraph 53 of art. 1, from the law 6.11.2012, n. 190 and from the D.P.C.M. of 18.4.2013 published in G.U. the 15.7.2013 and entered into force on 14.8.2013 sect. VIII autotrasporto account third parties (hereafter) established near the Prefecture of the province in cui the economic operator has his headquarters; or alternatively (see Circular Ministry of the Interior, protocol 25954 of 23.3.2016 and DPCM 18.4.2013 as updated by the Prime Ministerial Decree of 24 November 2016), must have submitted an application for registration to theabove held by the competent Prefecture.

Please refer to the Disciplinary of tender for everything concerning the modalities of prebids, the procedures for the evaluation of the bids, the subcontracting, the additional causes for exclusion and the other tender information. The tenderer must indicate, at the time of submission of the offer, the domicile elected for communications and the e-mail address for sending communications relating to the procedure. Please also note that before signing theRai Way S.p.A. contract verify that the awarded company possesses the following requisites necessary for the execution of the contract: - possession of the technical-professional requisites required pursuant to art. 26 paragraph 1, lett. a) of Legislative Decree 81/2008 and subsequent amendments for activities related to the object of the contract.

The participating companies undertake to prove possession of the requisito referred to in point a) above, in the absence of which Rai Way S.p.A. proceed with the cancellation of the award.

And anyway given the faculty to withdraw the same documentation of the tender in paper format, by appointment, by sending a PEC e-mail to the address cui in point I.1, at the headquarters of Rai Way S.p.A. Head of procurement - Management and logistics purchases, located in via Teulada 66, every working day (excluding Saturday) from 10:00 am to 4:00 pm. On the site www.raiwayfornitori.rai.it is also available, in order to facilitate bidders in the compilation of documents, the version of the tender forms. It remains that the verifica of the documentation and the consequent assessment of admission / exclusion from the tender will be made by Rai Way S.p.A. taking into consideration only the official documentation of the tender in paper format and / or where provided for digital and that responsibility for the correct preparation of the documents remains the sole responsibility of each bidder.
