GPA18702 open tender procedure for the awarding of scheduled and corrective maintenance for the stalls area and technical room automatic washing systemsor nonche attivita of driving and maintenance of the stations of sollevamento fognarie, pozos, piezometers network idrica and systems of disoleazione for the DR Piedmont of Trenitalia for n. 24 months renewable, under the same terms and conditions, for a further 12 months divided into n. 2 lots:

Main Site: Turin, Alessandria and Novara.

Scheduled and corrective maintenance service for the stalls and the local areatechnical automatic washing plants to be carried out at the IMC in Turin, Alessandria and Novara by Trenitalia for n. 24 months renewable, under the same terms and conditions, for a further 12 months.

The economic operator and any auxiliary company and any subcontractors must be in possession of the following general requirements as per art. 80 of Legislative Decree 50 / 2016.

a)Average annual average revenue realized during the three-year period 2015-2016-2017 at least equal to the following amounts:

- lot n. 1: 37 899, 97 EUR (thirty seven thousand eight hundred ninety nine / 97) excluding VAT,

- lot no. 2: 139 EUR 599.99 (one hundred thirty-nine thousand five hundred and ninety-nine / 99) excluding VAT.

It is hereby specified that this contracting authority requires an average annual average turnover asheld reliable parameter in order to allow the selection of a reliable and experienced economic operator in the sector covered by the tender, in consideration of the importance that the activities of this tender, to be carried out at the Trenitalia industrial plants, are part of the performance of the railway service.

It is specified that:

- in the case of competitors costsby groups of economic operators referred to in art. 45, paragraph 2, letters d), e), f) and g) of Legislative Decree No. 50/2016, it is specified that the above requirement may be split. In this case it must be held by the mandate (or group leader) not less than 40% (forty percent) of what is required for the entire grouping; the remaining percentage must be possitting together by the other companies belonging to the grouping (or the consortium or the EEIG), each in an amount not less than 10% (ten per cent) of the amount requested for the entire grouping. In any case, the agent (or group leader) must possess the aforementioned requirement to a greater extent,

- in case of participation in the tender by consortia referred to in the aforesaid art. 45, comm2, letter b) and c), the provisions of art. 47 of Legislative Decree 50 / 2016.

For the demonstration of the above ownership, the contracted companies and / or the economic operators of the groupings and consortiums mentioned above according to the established quotas, must present at the time of verification of the requirements copy of the documentation Evidence concerning the global turnover of Imtaken in the last 3 financial years (budgets 2015-2016-2017).

1. Pursuant to art. 89, paragraph 4 of Legislative Decree No. 50/2016, recourse to the institution of the transfer is not permitted for the following requirements: UNI EN ISO 9001 rv certification, possession of employees qualified to operate in confined spaces pursuant to Presidential Decree 177 / 2011; 2

. Trenitalia will verify the actual existence of the reqthe requirements referred to in paragraph III.1 above) with regard to the highest bidder. In the event of a negative outcome, Trenitalia will proceed to its exclusion from the tender for the forfeiture of the provisional deposit as well as the ANAC notification and the award in favor of the first of the following competitors in the ranking, subjected to positive checks; Trenitalia reserves the right to echeck the actual existence of the requisites referred to in paragraph III.1 above also with regard to other bidders. In the event of a negative outcome, Trenitalia will proceed to their exclusion from the tender, the forfeiture of the provisional deposit and the notification to the ANAC;

4. Trenitalia reserves the right to proceed, prior to the award, to the verification and possible exclusionof abnormally low tenders ex art. 97 of Legislative Decree 50/2016;

5. Trenitalia reserves the right to interrupt or cancel the tender at any time on the basis of assessments of its own exclusive competence without the competitors having any rights or expectations whatsoever;

6. Trenitalia reserves the right to proceed with the awarding even in the presence of only one valid offer;

7. Trenitalia reserves, inin the event of termination of the contract due to failure of the assignee, or his failure, to contact the second classified in order to stipulate a new contract for the continuation of the services, under the same conditions already proposed at the time of the offer. The above until the list of validly formulated offers is exhausted;

8. Trenitalia reserves the right to excludethe competitors for whom, according to their motivated assessment, there is no adequate professional reliability as they have been incurred in the last three years:

i) in the resolution for non-fulfillment of contracts for works, services and supplies entrusted by Trenitalia contracting authorities or other companies of the FSI group;

ii) in the failure to take delivery, by their own fact and strikesa, of works, supplies or services entrusted by Trenitalia or other company of the FSI group; iii) in the declared non-tested works, services and supplies covered by a contract with Trenitalia or other company of the FSI group; violation, during the execution of previous contracts or on the occasion of participation in previous tender procedures, of one of thethe rules contained in the code of ethics of the FSI group, ascertained by Trenitalia with any means of proof;

9. Trenitalia reserves the right to exclude offers presented by RTI consisting of 2 or more economic operators that individually possess the financial and technical requirements for participation if an analysis of the structure and dynamics of the market concerned or anyelement, find a precise anti-competitive will of the companies involved;

10. This announcement is published in GUUE, GURI, on the website of the Ministry of Infrastructures and Transport www.serviziocontrattipubblici.it, on www.acquistionline.trenitalia.it and on the newspapers: Il Corriere della Sera, La Repubblica;

11. the contract regulating the contract subject to this procedure is not cothe arbitration clause arises,

12. the person in charge of the proceeding and responsible for the Trenitalia regional purchasing structure.
