Open procedure in electronic format framework agreement concerning the supply of electricity and related services for Poste Italiane and for Group companies

Supply of electricity and related services for Poste Italiane and for Group companies.

Contract pursuant to Legislative Decree 50/2016 - open procedure in electronic format framework agreement concerning the supply of electricity and related services for Poste Italiane and for Group companies for a total estimated value of volumes equal to 1 363 382 MWh of which 1 248 758 MWh for Poste Italiane and 114 624 MWh for the Crane companiesppo. The total estimated maximum amount of the contract is EUR 249 025 982 of which EUR 227 666 367 for the Italian Post Office and EUR 21 359 615 for the companies of the Group.

The participation of the subjects referred to in Article . 45 of Legislative Decree 50/2016 and amendments with the procedures referred to in art. 47 and 48 of Legislative Decree 50/2016 with the following conditions:

a) C.C.I.A.A. or equivalent body in caof companies belonging to the EU;

b) lack of all the reasons for exclusion pursuant to art. 80 Legislative Decree 50/2016 as referred to in art. 133, co. 1, of said decree;

c) authorization of the Ministry of Economic Development to sell electricity to end customers, in compliance with art. 17 of Legislative Decree 164/2000 and subsequent amendments

As further specified in the CSO part I integr. Partante and substantive of the present announcement.

d) specific turnover realized in the last 3 financial years approved on the deadline for the presentation of the offer, concerning the supply of electricity that will not have to be less than 150, 000, 000.00 EUR;

e) list of the main contracts stipulated for the turnover referred to in letter d) above, relating to the supplyElectricity supply carried out within the free market, with the indication for each of the contracts: the subject of the service, the customer, the reference period, the total duration, the total amount and the relative annual amount (described, albeit synthetically, with sufficient clarity).

With regard to the aforementioned points indicate clearly identified references everifiable.

Race carried out with electronic tools support pursuant to art. 52 of Legislative Decree 50/16. The interested companies will have to previously and compulsorily ask for authorization of the portal www.posteprocurement.it.

To participate in the tender Companies must have the minimum technical equipment indicated on https://www.posteprocurement.it/esop/tlp-host/public/poste/web/ dotazione_tecnica.jst.

Documentazioit must be signed if requested with a valid digital signature certificate issued by a body listed in the public certifying agency Digital Italy.

Clarification of the tender content may be requested in Italian by authorized companies using online messaging in a section dedicated to a tender with terms and conditions of which CSO Party I.

For anything not foreseen, reference should be made to CSO Part I and attachments. 89 of Legislative Decree 50/2016, the participating company, individually or in RTI / consortium, will have to provide with a request to participate / offer the provisions of art. 89, documentation such asby CSO Part I.

In the case of participation in RTI, each member must certify in possession declaration requirements a), b), c) of point III.1.1.

the requirements of letter d), e), point III.1.2 ef) point III.1.3 must be owned by the agent at a rate of not less than 60% and by each principal at a rate of not less than 20%, it being understood that RTI must ownand its total 100% requisites required for tender participation. The requirements g) and h) of point III.1.3 may be held by the RTI as a whole.

In the case of ordinary consortia, at least one of the associated companies must meet the requirements for the agent, while the others must meet the requirements for the / the principal / principals.

Documentation not in Italian must esbe accompanied by a sworn translation in Italian.

Subject to the provisions of art. 32, co. 7, of Legislative Decree 50/16, Poste has requested proof of possession of the requisites declared and the company must provide the requested service within the time specified by Poste. Negative outcomeivo verification will result in exclusion from the tender. In the event of awarding the contract, the contract will be revoked with the right to award the tender to the next competitor in the ranking.

Poste reserves the right not to continue, in whole or in part, the completion of the tender and / or to award in part. tender procedure does not constitute the obligation of entrustment to Posteof the service as a whole or in part and in no case may the competitors, including the successful bidder, be entitled to any compensation for reimbursement or compensation for the presentation of the offer. `framework agreement pursuant to art. 95, co. 12, of Legislative Decree 50/16.

Poste has facultyto proceed with adjudication in the presence of only one valid offer or in the case of only two valid offers remaining in both cases application pursuant to art. 95, co. 12, of Legislative Decree 50 / 16.

Poste per anomaly verification will proceed pursuant to art. 97 of Legislative Decree 50/16.

Poste reserves the right to avail itself of art. 110 of Legislative Decree 50 / 16.

Client specifies that the amount and quantity of the framework agreement are presumed and potrannor vary according to needs of the Poste Group. Contractor will not be able to claim amounts for amounts lower than those estimated for assignments. 216, co. 11, of Legislative Decree 50/16 will have to pay within 60 days from adjudication to reimbursement to the customer expenses incurred for publication of notice in newspapers estimated at 6, 000.00 EUR plus VAT which will be reimbursed in the manner indicated by Poste

The successful tenderer will be required to send proof of payment to Poste
