Competition for the supply of electricity to public entities of the Basilicata Region - SEL EE7

The tenderer of the tender lot undertakes to stipulate the related framework agreement with the Lucana Energy Company for the supply of electricity to of public subjects referred to in art. 9, paragraph 2, lett. c), of the regional law of Basilicata n. 31 /2008.

The competition concerns the selection, by means of an open community procedure with public evidence, of an economic operator supplying electricity to the requesting administrations referred to in art. 9, paragraph 2, lett. c), of L.R. Basilicata n. 31/2008, below (except for the administration having utilities used for the management of the integrated water service - ie, Acquedeight Lucano S.p.A. -, for which there is lot 2), within a pre-established maximum quantity. The tender is awarded on the basis of the criterion of lower price, pursuant to art. 95, paragraph 4, lett. b) of Legislative Decree 50/2016 (also), being a supply having standardized characteristics and subject to regulation by ARERA. Competitors must possess general requirementsand specials as specified below. The Lotto contractor undertakes to stipulate a framework agreement with the Lucana Energy Company () for the supply of electricity to the administrations and, in order to stipulate the contracts for the implementation of the agreement and to take advantage of the conditions regulations and economic provisions therein, will have to issue and isend the supply orders according to the modalities and terms foreseen in the tender documents. With the signing of the agreement, the supplier undertakes to accept the supply orders issued from time to time by the administrations and to supply them with the required electricity within the maximum quantity of 340 000 000 kWh. The maximum quantity and the result of an estimate relating to-presumed electricity needs of the administrations over the period of the agreement, including the possible extension of the implementation contracts. The total economic value of the agreement is EUR 57 800 000.00 net of VAT. The unit value of the kWh, estimated on the basis of the average cost of electricity and equal to EUR / kWh 0.170 plus VAT. In the quantifthe amount was also taken into account for the possible extension.

The administrations are not in any way bound to the use of the agreement, but have done it, nor are they obliged to ask the supplier for a minimum quantity of electricity. The convention does not give rise directly to the obligations on the part of the administrations, which will be bound only in itthe case in which they stipulate a supply contract and limited to the content of the same.

The competitors must have the following professional qualification requisites:

To be registered in the Business Register for activities related to this supply, in compliance with the provisions of art. 83 of the Code.

Competitors must have the following echo capacity requirementsnomic and financial: over the last three years, a specific VAT turnover has been achieved, excluding electricity supply not below:

- EUR 115 000 000 for lot 1,

- EUR 85 000 000 for lot 2.

The possession of the economic-financial requisite (specific turnover for electricity supplies realized in the last three years not less than athe amounts indicated above), without prejudice to the art. 86, co. 4, of Legislative Decree No. 50/2016, must be so proven:

- for joint-stock companies, it must appear on the financial statements, including attachments and notes of deposit, relating to the last three years for which the financial statements are approved and deposited on the date on which the invitation to tender was sent to the Official Journal,

- for competitors other than capital companies, -the possession of the requirement must be the subject of a declaration as per attachment xVII to the Code, part I, lett. c).

Resolution to contract: deliberation of the sole administrator of SEL n. 18AU042 of 12.7.2018.

Compared to both lots yes-make the following information:

Requirements: with regard to the requirement of economic and financial capacity, it is specified that the sum of the specific turnovers (for electricity supplies) made in the last three years must be at least equal to the amounts indicated above. The competitor who intends to participate in both lots must possess the economic requirement, so coif requested, for participation in the lot of a higher amount, otherwise, it will be admitted to participate only in the lot for which it has the requisite. The competitor first result in the provisional rankings of both lots will be able to win them all only if it is in possession of the sum of the economic-financial requisites required for participation-to each of the aforementioned lots. Failing that, he will be able to win the lot for which he has opted for in annex 1 bis and will be excluded from the provisional ranking of the unspecified lot.

Specific turnover: the limit of specific turnover, in compliance with art. 83, paragraph 5, of the Code, and requested in relation to the particularity of the services served and the requested service. Because all-utilized utilities are public, many of them in the sanitary and water sectors, to them a supplier must be guaranteed that, in the previous three years (in the above mentioned terms) has, at least, carried out overall supplies of electricity that have generated a turnover equal to the value before indicated. The specificity of the requested performance determines the need to have-an adequate financial capacity and technical and administrative skills that are believed to have been accrued following the performance of similar activities and characterized by such sales volumes.

Provisional guarantee: equal to 2% of the total economic value of the agreement. The guarantor must expressly undertake to renew the warranty in the event that at the time of hisThe award has not yet expired. Subcontracting is permitted within the terms and according to the procedures specified in the tender documents. The indication of the number of subcontractors is obligatory.

Other

Minimum period during which the bidder is bound to his offer: 180 natural and consecutive days from the deadline for the submission of the offer.reserves the right to:

- not proceed with the award if no offer is convenient or suitable in relation to the subject of the contract,

- proceed with the awarding even in the presence of only one valid offer.

Suspend, re-submit or not award the motivated race

The paper package containing the offer must be received at the SEL Protocol Office, in corso Umberto I 28, The plan, Potenza, within the above deadline, under penalty of admissibility of the offer and in any case the non admission to the procedure.

Deadline for the request for clarifications: 24.8.2018.

The agreements will not contain the arbitration clause.
