Candidates must hold the qualification of the ARERA, or the corresponding body in one of the states of the European Community and dovra to declare the possession of this requirement in the DGUE. In the case of the RTI or consortium, this requirement must be possessed by all the subjects belonging to the RTI or consortium. All economic operators who meet the requirements of the tender notice and for which there are no grounds for exclusion and incompatibility provided for by current legislation and byThe notice in compliance with the provisions of Articles 45, 47, 48, 49 and 80 and ss. of Legislative Decree no. 50 / 2016e s.m.i.

In particular, the participation in the competition of the competitors is not allowed: a) for which there are causes of exclusion of the art. 80 of Legislative Decree no. 50/2016, as well as any other situation that determines the exclusion from the tender and / or the incapacity to contract with the Public Administration-pursuant to current legislation;

b) that, pursuant to Article 48, paragraph 7 of Legislative Decree no. 50/2016, participate simultaneously in the procedure individually and in temporary grouping or ordinary consortium, or in more than one temporary grouping or ordinary consortium or individually or in temporary grouping or ordinary consortium and as a member of a consortium stabile or of a consortium of cooperatives or of handicraft enterprises for which the consortium concurs and to this end indicated for the execution;

c) that are interested from the individual plans of emersione of cui to the art. 1-bis, paragraph 14, Law 383/2001, if these plans have not yet been completed;

d) to which the exclusion from tenders has been imposed for serious discriminatory behaviors in accessat work, pursuant to art. 41 of Legislative Decree 198/2006; e) to which the exclusion from tenders for serious discriminatory behavior (for racial, ethnic, national or religious reasons), pursuant to art. 44 of Legislative Decree 286/1998;

f) for which the ban on contracting with the public administrations pursuant to art. 53, paragraph 16-ter of Legislative Decree 165/2001.

The candit will have to declare in the DGUE, under penalty of exclusion, that it has achieved a minimum turnover related to the supply of electricity. In the case of RTI, by constituting or constituting, the requirement must be possessed by each company according to the shareholding in the grouping.

1) The application for participation in the tender must be signed by the legal representative of the candidate with aattached photocopy of a document identifying the subscriber, and should contain the indication of the form with which the candidate intends to participate in the tender by specifying the pec address to receive communications regarding the tender procedure; the request can also be signed by an attorney and in this case the relative power of attorney must be sent. In the case of candidate chosted by RTI / consortium not yet constituted the application must be signed by all the subjects that will constitute the RTI / consortium and must be indicated the person who performs the functions of the parent company. In the case of RTI, the participation quotas of each subject must be indicated. In the case of consortia, the consortium must compete for the consortium. In the case dthe RTI / consortium / GEIE already established must be submitted a certified copy of the irrevocable collective mandate or of the deed of incorporation;

2) the envelope containing the documentation requested in section III) of this call for tender, under penalty of exclusion suitably sealed, it will have to report in addition to the sender's header - the words "RESERVED DO NOT OPEN PARTICIPATEZIONE TO THE COMPETITION REPORTING TO: ELECTRICITY SUPPLY YEAR 2019 IGC 7624823AFB ", must be registered and sent to Acqua Campania SpA UNIT APSAQ CENTRAL ISOLA C1 80143 NAPOLI by registered mail of the postal service, or by hand or by delivery agency; 3) a complete contents index must be produced in the envelope;

4) no documents will be acceptedsent by fax or e-mail;

5) the request to participate does not have to report prices or tariffs;

6) duplications of requests for participation and direct offers are not allowed, nor through;

7) the request for participation does not bind the contracting entity in any way. The awarding entity reserves the right to transmit invitations to candidates whose applications are requestedof participation is found to comply with the requirements set out in this notice, setting the deadlines for the submission of tenders. This notice and the receipt of any offers do not entail any obligation or commitment to the contracting entity to award bidders to any bidders, granting them any right or any benefits fromof the contracting entity, in any capacity. The adjudicating entity also reserves the right, at its sole discretion and without any right or claim by any candidates, to annul this notice and / or not to proceed with the award if it has not identified, at its sole discretion, any offer that is found to be fair and convenientthat to proceed with the provisional award even in the presence of only one valid offer;

8) for this contract no risks were identified from and, therefore, the contractual cost of the security burdens equal to 0;

9) the opening of the envelopes containing the applications for participation will be carried out in public session at the Offices of Acqua Campania SpA at 14:00 o'clock24.10. 2018. The legal representatives of the candidates or the subjects, one for each candidate, provided with specific delegation conferred by the aforementioned legal representatives, are admitted to the opening;

10) the invitations to tender will be accompanied by special documents and their attachments on the basis of which the offer must be formulated;

11) each Candidate invited to submit orrequesting proof of payment of the contribution of EUR 200.00 to the ANAC indicating the following IGC: 7624823AFB.
