The present proceedings are not subject to public procurement law. It is a so-called open-house procedure. The subject of this open-house procedure is the appraisalof non-exclusive discount agreements on the provision of insured persons of AOK Baden-Wuerttemberg with dressings for the purpose of conventional and modern wound care within the meaning of - 31 (1) sentence 1, para. 1a SGB V i. V. m. - 7 No. 1 and - 27 (5) of the Medicines Directive of the GBA. At the beginning of the contract in the rest of Ziff. II.2.14). The waiting and standstill period in the rest of Absection A.III.9. The subject of the present public procurement-free open house procedure is the conclusion of non-exclusive discount agreements on the provision of insured persons of AOK Baden-Wuerttemberg with dressings for the purpose of conventional and modern wound care in the sense of Section 31 para. 1 sentence 1, para. 1a SGB V i. V.m. - 7 No. 1 and - 27 (5) of the Medicinal Products Directive of the Federal Joint Committee (AM-RL). The subject of the contract is all dressing material within the meaning of VDB Group 35 (VDB = "Contract Database" of the German Pharmacy Association, which can be called up via the so-called Lauer-Taxe [= Large German Specialty Tax]), which can be distributed or obtained in Germany(For details see the contract and the conditions of participation including annexes). The contracting partner of the AOK has to grant a rebate of 23% on the relevant pharmacy purchase price (AEP) according to the Lauer-Taxe by way of reimbursement to all insured persons of the AOK that are outside the consultation hours(see in detail - 3 of the contract = Annex 1 to the conditions of participation). The procedure is based on a more detailed specification of the conditions of participation, including attachments, to all providers of dressing material (within the meaning of - 31 (1a) SGB V) who, in relation to the respective bandages, bring their bandage under their own name onto the market. The participation is available to allCompanies domiciled in Germany or in a Member State of the EU or the EEA who market to the AOK in the name of the insured in statutory health insurance prescription dressings in Germany.
