Open procedure for the conclusion of framework agreements for the supply of diesel fuel for oil and heating oil.

The open procedure, divided into n. 2 (two) lots, and aimed at the conclusion, in relation to each lot, of a framework agreement with a single economic operator, pursuant to art. 54, comma 3, of Legislative Decree no. 50/2016 and subsequent amendments and supplements, pursuant to which Herambiente SpA, a member of the Hera Group, is involved in the supply of diesel fuel for motor vehicles and heating oil, including delivery to warehouses and / or other points located in the territory served by the Client, as specified in the Special Supply Specifications.

Lot no. 1 - Framework agreement with a single economic operator, pursuant to art. 54, paragraph 3, of Legislative Decree no. 50/2016 and subsequent amendments, for the supply, including delivery to the warehouses and / or other points located in the area served by the Client, of Diesel fuel to UNI EN 590, with sulfur content of 10 PPM (ref. European Directive 2009/30 / EC) or, in any case, fullcompliant with the legal provisions in force at the time of delivery, usable on modern engines with common rail technology, equivalent to products in normal distribution on the network, distributable by internal distributors used by the Customer without the need to add special additives necessary to thin the product and avoid the deposit and accumulo of substances of any nature, except in the cases, at the request of the Client, determined by the seasonal climatic conditions. www.gruppohera.it/fornitori/Bandi/, in particular, refer to the provisions of points III.1) and III.1.1) of the tender notice. A) declaration of registration in the Register of Companies of the Chamber of Commerce, containing all the information promptly indicated in the forms attached to the aforementioned specifications (Annex B); exclusion pursuant to art. 80 of Legislative Decree no. 50/2016 and subsequent amendments, as promptly indicated in the formsattached to the aforementioned tender specifications (Attachment B and possibly Attachment C), including the declarations regarding the aforementioned art. 80 by any terminated subjects, as promptly indicated in the forms attached to the aforementioned tender specifications (Annex D);in the matter of safety foreseen by the current legislation;

d) declaration showing the indication of the competent administrations / bodies with which the Contracting Authority can perform the official verifications on the possession of the requirements of the art. 80 of Legislative Decree no. 50/2016 and ss.mm.ii. complete with all the contact details (fax, telephone, PEC) necessary for the forwarding of the relative requestsste;

e) statement showing the acknowledgment and acceptance of the provisions contained in the documents of the Hera Group, all viewable on the SRM online platform, in the area reserved for Economic Operators, in the Documentation Area / Documents Qualification / Standard Documentation / A ) Important - Documents to view and accept, as well as the provisions contained in the Note Intraining program for Hera Group Supplier List, available on the SRM online platform, in the area reserved for Economic Operators, in the Document Area / Qualification Documents / Standard documentation path - Documents useful for Hera Group supplier list qualification, and the provisions contained in the Manual technological requirements to access the portal, available at the link http: //www.gruppohera.it/fornitori/diventare_fornitore/helpdesk/pagina22.html

f) declaration to take note that for the reception of any communication as per art. 76 of Legislative Decree no. 50/2016 and ss.mm.ii. and / or requests for clarification and / or integration of the documentation presented, the Contracting Authority may use the certified e-mail address of the Economic Operator indicatedto by the same in his identification data or, in case of impossibility, the fax of the Contact Person registered in the SRM system.

In the case of constituting a Temporary Grouping of Competitors, this declaration must be made only by the Economic Operator Parent Company representative, as well as in the case of the Consortium it must be made only by the Consortium and not by the Consortium Members indicated herethe executors of the activities covered by the contract;

g) declaration authorizing the Contracting Authority to perform, pursuant to GDPR UE 2016/679, the processing of data provided by the declarant in the present proceeding, for the sole purpose of carrying out its own institutional activity ; h) declaration showing compliance with the originals owned by the Economic Operator of all copiesand of the documents presented in accordance with the provisions of this announcement;

i) declaration showing that they have made all the declarations required in this announcement in the knowledge of the penal sanctions provided for by art. 76 of the D.P.R. n. 445 / 2000.

j) copy of suitable bank reference, at least 2 (two) months from the date of this announcement, of at least 1 (one) credit institution, authorized pursuant to Legislative Decree no. 353/90 and ss.mm.ii., certifying the economic and financial capacity of the competing Economic Operator.

- In case of participation in constituting RaTemporary grouping / Ordinary Consortium of Competitors, it is required that the designated Economic Operator as Parent-Mandate Manager and each Economic Operator designated as principal, provide suitable bank reference, at least one credit institution each, attesting the economic and financial capacity of the Economic Operator himself;

- In the case of the participation of Consortia dreferred to in art. 45, paragraph 2, letter b) and c) of Legislative Decree no. 50/2016 and ss.mm.ii., this requirement must be held by the Consortium itself.

K) declaration certifying the specific turnover for supplies similar to those covered by the contract carried out overall in the last three financial years, showing a total specific turnover of at least:

- for participationone on Lot 1: EUR 1 200 000.00 (one million two hundred thousand / 00),

- for participation in Lot 2: EUR 200 000.00 (two hundred thousand / 00)

We specify that similar supplies are intended. Please note: By this is meant the last 3 financial years approved on the date of publication of the announcement. Although the 2018 budget has not yet been approved, if the financial year (or part of it)relating to that year, however, it can already be documented with other valid documentation of a fiscal and / or contractual nature, then this period can also be taken into consideration.

It remains understood that the specific turnover for similar supplies must in any case have been realized in three financial years.

As proof of the aforementioned declaration, the competing economic operator must produce a corof the declaration itself a list of orders / contracts for realizations similar to those covered by the present tender procedure as defined above.

For each contract / order, this list must contain the following information: of the supply with the exact indication of their company name and contact details (PEC, telephone, fax) at thewhich the Client can carry out the official verifications in order to verify the truth of what declared by the competitor. aforesaid time frame; d) the duration of the supply (starting date and contractual expiry date).

Data of the aforementioned List ofthey must be confirmed by appropriately attaching to the same, with specific reference and punctual reference in the same List, certificates of good outcome of the supplies issued by the Client with explicit evidence of all the above information and useful to verify the possession of the requirement, alternatively, the self-certification of the competitor attesting the regular executionof the supplies themselves.

In the case of participation in both lots, the tenderer must certify a total specific turnover (and, consequently, produce a list of contracts for similar supplies) for an amount of EUR 1 400 000.00 ( one million four hundred thousand / 00).
