By granting investment subsidies, the still underserved subscriber lines located in the district of Mainz-Bingen will be connected via an NGA network. There are to be 2, 338 residential addresses, the equivalent of about 2, 806 households, 236 business addresses-in 25 industrial parks and 65 schools with a high-performance broadband infrastructure. As an option, the connection of 62 outer layers is planned. Furthermore, the optional expansion of 2 hospitals or clinics is planned. The granted investment aid is to be used exclusively for the creation of an NGA network. The network operator is obliged to Bto set up a rolling-stock infrastructure, to install active components, to put them into operation and to operate them for a minimum period of 7 years and to provide corresponding services and offers.

The tenderer must name all subcontractors to whom he awards services at the latest in his tender. The Bewthe applicant community already in the competition for the performance of another company (subcontractor) are subject to the requirements set out in section III.1). The replacement of a subcontractor, to which the applicant has referred as proof of suitability in the competition, is not permitted after the end of the competition. Goal of this partcompetition is the identification of suitable bidders for the use of investment subsidies for the establishment and operation of a NGA network, with the result that the legal requirements for the execution of a procurement procedure according to -- 97 ff. GWB and the EU Directive 2014 / 24 / EU can not find direct application. Nevertheless, the invitation to tender for this provision shouldin accordance with the principles of public procurement law, in particular the principle of transparency and the principle of equal treatment. However, a legal claim to the application of procurement regulations is not justified. With this competition the public contracting authority will not be awarded a grant or a contract with one of the candidatesagrees. In particular, the public contracting authority reserves the right to award the contract should the broadband project prove to be unaffordable or financially feasible as a macroeconomic measure. Such an inefficiency of the current broadband expansion project is to be assumed, in particular, if the funding funds advised by the district are not the same for whatever reasoncould be acquired to the planned extent. The funding is based on the Guidelines on Support for Broadband Expansion in the Federal Republic of Germany of 22.10.2015 ("Federal Funding Directive") (1st amendment of 3.7.2018) and the directive of the Ministry of the Interior for Sport and Infrastructure to support the expansion high-speed broadband networksn of 11.11.2015 ("Landesfoerder-richtlinie") Furthermore, the public contracting authority can not assume any costs which may be incurred by the bidders in connection with participation in the competition or the preparation of tenders
