Background:

The Security Council has mandated the United Nations Integrated Peacebuilding Office in Guinea-Bissau (UNIOGBIS) to assist, coordinate and lead international efforts in support of the national government to combat Drug trafficking and other forms of Transnational Organized Crime (DTOC), in close cooperation with UNODC, in order to achieve political and economic stability in the country. Acknowledging the threat posed by DTOC to the political, security, socio-economic and humanitarian situation in the sub-region, Guinea-Bissau and its neighborhood have been identified as the weakest link in the international efforts to combat drug trafficking within West Africa.

Guinea-Bissau has been described as a ‘narco-state’ and a drug trafficking hub. However, some studies consider that using the term ‘narco-state’, where much of the state has little or no capacity, is inappropriate. Few studies analyze how drug trafficking has evolved in Guinea-Bissau and how it impacts the political, security, socio-economic and humanitarian situation in the country and sub-region.

Nevertheless, perceptions that Guinea-Bissau remains a major transit and repackaging hub for drugs flowing from other continents to regional and northern hemisphere markets persist. Its geography makes detection difficult and porous borders a safe route, thus victimizing the whole country and sub-region. The security of lives and property of citizens and residents in Guinea-Bissau and the sub-region is threatened by DTOC. Since campaigns against drug trafficking across the world do not seem to have impacted positively on Guinea-Bissau, it is imperative that a comprehensive analysis on DTOC in Guinea-Bissau and the sub-region be launched.

Objective:

The purpose of the consultancy is to provide a comprehensive DTOC analysis of the relevant issues, inclusive of geo-political, socio-economic and security aspects and impact, that will provide a baseline study for informed strategic interventions at the origin, transit and destination.

Scope of Assignment:

The study is expected to cover:

· DTOC and root causes: Identify the key factors that contribute to DTOC;

· DTOC and trends: Identification of the trends of DTOC in Guinea-Bissau and the sub-region;

· DTOC and its financial impact: Need to determine the extent of capital flight that results from the money laundering and corruption aspects;

· DTOC and impunity: The non-completion of the due process of criminal justice on DTOC cases generates a perception of endemic impunity and lack of individual and institutional accountability;

· DTOC and food safety and supply: Identify eventual linkages between drug trafficking and food safety and supply;

· DTOC and adequacy of existing legal provisions: Identify if existing international and national legal instruments are adequate for comprehensively addressing the issue inclusive of the health aspect arising from the consumption of trafficked and illicit drugs;

· DTOC and consumption: If Guinea-Bissau is a transit point it may also be a consumption point, thus the need to identify eventual consumption patterns and its linkage with social stability and health, and how that would compare to the trends in the sub-region;

· Assessment of institutional capacity: Mapping the capacity of the various institutions inclusive of the law enforcement agencies, judiciary, parliament and executive is crucial in determining the scope of the problem and in devising strategies for solutions.

Deliverables:

Under the direct supervision of the Chief of Service, Rule of Law, who will also coordinate with UNODC, the consultancy will help design and implement the following outputs:

1. Submit a report on root causes and mapping of institutional capacity to prevent and combat DTOC;

2. Submit a comprehensive technical proposal (policy and strategies) for effectively combating DTOC and mitigating its impact in the sub-region notably focusing on Guinea-Bissau and linkages with the situation in the West Africa sub-region;

3. Submit a baseline research paper on state responses to DTOC in Guinea-Bissau and the neighboring countries and its eventual linkages with multiple forms of trafficking, violent extremism, financing of terrorism and other forms of transnational organized crime;

4. Design and propose international, regional, sub-regional and related national initiatives targeted to administration of criminal justice on DTOC;

Timeframe: The consultancy is for a period of 3 months.

Meetings:

Startup meetings: There will be an initial meeting with the SRSG, the DSRSG and the Chief of Service, Rule of Law, who will also coordinate with UNODC. This is to address any issues that may need clarification arising from the Terms of Reference.

Consultancy meetings: As the consultancy demands. Coordinates with UNIOGBIS substantive areas, the relevant United Nations Country Team (in-country) members, relevant intergovernmental organizations, diplomatic corps and national and international institutions which are interested in the combat of DTOC and can provide technical assistance on the related issues at the sub-regional and country level. Hold meetings with national relevant institutions and individuals.

Reporting guidelines:

The consultancy will include multiple briefing sessions with the SRSG, DSRSG and Chief of Service, Rule of Law, who will also coordinate with UNODC, as required and will present an end of consultancy report through the Chief of Service, Rule of Law, who will also coordinate with the UNODC, incorporating the findings and deliverables with actionable recommendations.

Education:

Advanced university degree in security studies, criminal justice, law, criminology, defense, criminal intelligence, social sciences or other related discipline is required. A combination of a first level university degree and a qualifying number of relevant years of experience (10 years) might be considered in lieu of the advanced degree.

Work experience

The consultant must have at least ten (10) years of relevant experience preferably working in institutions of rule of law or security, with at least five (5) years of experience researching issues related to DTOC; Should have extensive experience working on policy issues affecting peace, security and rule of law in developing countries; Should ideally have written or published extensively in a related area and in renowned journals or for think-tanks, academia or state institutions.

Languages

English and French are the working languages of the United Nations. Portuguese is the official language of Guinea-Bissau. For this position, fluency in oral and written English and knowledge of Portuguese is required. Knowledge of French is desirable.
