Conclusion of discount agreements in accordance with Section 130a Paragraph 8 SGB V in the form of active ingredient-related framework agreements for drugs containing antibiotics as well as medicinal products that are classified as medicinal products in accordance with Section 130a Paragraph 8b Sentence 3 SGB V Federal Ministry of Health impending or existing supply-relevant market concentration were classified in the multi-partner model. This means that the law is intended to combat supply bottlenecks for off-patent medicines and to improve the supply of them Children's medicines (Medicine Delivery Bottlenecks and Supply Improvement Act - ALBVVG) of July 19, 2023 (Federal Law Gazette I 2023 No. 197) must take into account the newly introduced regulation of Section 130a Paragraph 8a SGB V. The tender is divided into 56 lots in total divided equally between EU lots and the corresponding world lots, Section 130a Paragraph 8a Sentence 3 SGB V. The corresponding EU and world lots can be recognized by the internal reference with the same number and each with the Additions a) and b) (see Appendix L). EU and the associated world lot are viewed uniformly and each contain identical VGG and packages. It should be noted that the values from the respective EU lot and the corresponding world lot are not are additive, but rather relate to an active ingredient within the framework of a three-partner model. While up to 2 bidders can be awarded in the world lot, in the corresponding EU lot only a maximum of 1 bidder will be awarded the contract, provided that Economic efficiency criteria are met.
