If it is in the tender conditions, technical specifications, project documentation or bill of quantities refer to certain suppliers, products or patents for inventions, utility models, industrial designs, trademarks or designations of origin, then in accordance with the provisions of § 89 paragraph 5 of Act No. 134/2016 Coll., on awarding public contracts, considers such a reference to specify technical conditions, which would not be sufficiently precise and understandable without its use. For each such link, the client explicitly mentions and admits the possibility of offering another equivalent solution. The contracting authority expressly allows such a change in the technical design when it is not a change in the performance parameter or a binding technical parameter (e.g. volume), i.e. when there will be no change in the approved TS of the car, but other components will be used, but which must be approved by HZS for the given use. A participant in a public contract can propose a qualitatively and technically similar solution with qualitatively the same or better parameters.
