The subject of the order is the delivery and installation of a mobile wall as part of task 43996 Nowa Dęba. The Ordering Party reserves the right not to invite the Contractor who is a party previously concluded contract(s) for an order with the Ordering Party, within the scope of which the contract was terminated, the contract was withdrawn, the execution of the contract was not commenced or contractual penalties were charged for the fulfillment of a significant obligation inconsistent with provisions of the contract for the order, substitute performance in the scope of removing defects in the subject of the contract was entrusted to a third party at the expense of the Guarantor, either of the parties filed a lawsuit against the other party. The Ordering Party reserves the right to that it will not invite a Contractor who unjustifiably withdrew, within the last 3 (three) years before submitting the application, from signing the contract or evaded concluding the contract after the Company selected its offer.
