This invitation for bids follows the General Procurement Notice for this project, which was published in the newspapers El Imparcial (Nogales, Sonora) and Arizona Daily (Nogales, AZ), in the specialized section of the Diario Oficial de la Federación and via Internet in the newsletter NADBank News on January 26, 2017.

The local water utility, Organismo Operador Municipal de Agua Potable, Alcantarillado y Saneamiento de Nogales (OOMAPAS or the Executing Agency) has received a grant from the North American Development Bank (NADB), through its Border Environment Infrastructure Fund (BEIF), which operates with contributions from the U.S. Environmental Protection Agency (EPA), to finance part of the cost of the project to expand the water and wastewater systems to the southwest area of Nogales, Sonora, Mexico (the “Project”).

Qualified interested companies are hereby invited to submit technical and financial bids in Spanish in a sealed envelope, for a unit-cost, fixed-term contract to carry out the following work:

Required Minimum Net Worth: $4, 000, 000 pesos.

Site Visit: March 24, 2020, at 9:00 a.m. (local time)

Pre-bid Meeting: March 24, 2020, at 1:00 p.m. (local time)

Bid Submission and Opening: April 7, 2020, at 11:00 a.m. (local time) Work Duration: 120 calendar days.

The probable start-up date for this contract is May 15, 2020, and the expected completion date is September 13, 2020.

Bidding for contracts financed by NADB is open to firms from any country. Because the funding for this project is administered by NADB, the bidding process will be carried out in accordance with its procurement policies. Companies that have been previously penalized by NADB and/or had contracts cancelled by OOMAPAS are not eligible to participate in the bidding process.

Bids may be presented in U.S. dollars or Mexican pesos. Monthly invoices will be paid in the currency indicated in the bid. For the purposes of evaluation only, the exchange rate published in the Diario Oficial de la Federación for the settling of obligations denominated in foreign currency payable in Mexico, will be used. The date used as the basis for the conversion will be six calendar days prior to the date for opening the bids.

An advance payment of 30% (thirty percent) of the total value of the contract will be provided.
Bid documents will be made available via Internet at www.Compranet.gob.mx; however, the
general requirements that will be requested in the bid documents and that must be covered in the
bid are as follows:
1. Legible, duly notarized copies of the company-s Articles of Incorporation, with its most recent
amendments, and the power-of-attorney for whoever is acting on the company-s behalf, recorded
in the Public Registry of Property and Commerce or its equivalent for foreign bidders.
2. The required minimum net worth not committed to other current contracts must be substantiated
using financial statements updated as of March 31, 2020 and the 2018 year-end financial
statement. The 2018 year-end financial statement must be audited by an independent, licensed
public accountant, who shall have to provide a letter on the auditor-s stationary indicating that the
auditor is responsible for the opinion of such statements, along with the auditor-s professional
license and the official authorization letter issued by the Mexican Ministry of Finance and Public
Credit (SHCP) or their equivalent for foreign bidders. For the financial statements as of March 31,
2020, the bidder must provide legal documentation substantiating any capital increases reflected
therein.
3. The most recent annual tax statement for the fiscal year immediately preceding or its equivalent
for foreign bidders.
4. Sworn statement of the list of current contracts with both public and private entities, indicating
the total value of the contract and the amount to be paid out in annual installments.
5. Brief description of the company, including its organization and the services it offers.
6. To substantiate the technical experience required for this contract, bidders must present legal
documentation (cover page and/or duly signed contracts executed in the past five years) that
demonstrates their technical capacity through works of a similar nature, size and value as those
advertised here, along with copies of the duly signed completion certificates (in the case of joint
ventures at least one of the partners must meet this point). Bidders must also present a list of their
equipment, available and sufficient for these works, and not currently contracted for use elsewhere,
as well as details concerning works executed during the last five years, including a brief description
of the activities carried out and the contact name and phone number for at least three of these jobs
as references.
7. Curriculum vitae (CV) of the technical personnel available to work on the project, signed by the
individual and the legal representative of the company. Consideration will only be given to the CVs
of those persons that have direct experience in completed contracts for civil engineering and water
works and in the areas of specialization required for this contract, and who could work in Spanish.
8. Companies in joint ventures must present the original joint venture contract duly signed by their
legal representatives, along with a description of the responsibilities and commitments of each
party, as well as indicate the lead company and the legal representative of the joint venture. For
the purposes of contract signing, the joint venture contract shall have to be notarized. Compliance
with the foregoing requirements must be met for each company in the joint venture, except for
points 2 and 6, which may be substantiated for the joint venture.
9. List of subcontractors that may participate in these works, including their name, address and
experience in their area of participation.
Bids must include a security bond worth at least five percent (5%) of the value of the bid, excluding
value-added tax, and be issued in the currency of the bid in the form of non-negotiable check of
the bidder payable to the “Organismo Operador Municipal de Agua Potable, Alcantarillado y
Saneamiento de Nogales, ” or a bond policy in favor of OOMAPAS, executed by an institution
authorized to operate in Mexico.
The general criteria for contract award will be based on a comparative analysis of the eligible bids.
A report will be prepared that will serve as the basis for the decision by which, if applicable, the
contracts will be awarded to the bidder whose proposal meets the required conditions, guarantees
satisfactory execution of the contract and works and presents the lowest evaluated bid under the
terms defined in the bid documents.
Payments will be made based on invoices for work performed, which must be prepared and
submitted no more than once a month.
These procurement processes are not covered under any treaty.
None of the conditions contained in the bid documents or in the proposals submitted by the bidders
are negotiable. Any term or condition proposed by the bidder that differs in any way with the
conditions imposed or required under the bid notice, will be cause for rejection of the bid.
