child protection in british columbia is governed by the child, family and community service act (cfcsa). Under the cfcsa, the director is the statutory authority responsible for child protection. The director assesses child protection reports, conducts assessments of families or child protection investigations, and brings children into care if necessary. The director is obligated to explore less disruptive measures (e.g. Providing support services, supervising the child`s care under court order, determining if there are family members or someone known to the child who can temporarily care for a child) prior to bringing a child into care. Section 22 of the cfcsa provides for the use of mediation to resolve disputes between the director and another person about an issue relating to a child or a plan of care for a child.



only mediators on the child protection mediation roster can be used to mediate child protection issues. Section 9 of the child, family and community service regulation (bc reg. 527/95) requires the director to establish a roster of mediators for the purpose of section 22. The child protection mediation program (cpmp) manages the roster to support mediator impartiality and strives to provide diversity, including indigenous mediators, within the roster. The director must choose from the roster a mediator acceptable to the person who has a dispute with the director.
