Purchase of BSZMK medicines and other products Tenderer for the various medicines required for 48 months (including magisterial preparations and including products financed with individual equity), medical aids and other preparations are intended to be purchased by Kbt. On the basis of a framework agreement concluded with several tenderers pursuant to Section 104, paragraph (3), which framework agreement is 6 months can be extended. The individual order, according to the conditions defined in the framework agreement according to Section 104, paragraph (3), is made by the contracting authority through a direct order from the tenderer selected according to Section 105, paragraph (2), point a). The requirement to extend the 48-month duration of the framework agreement by an additional 6 months is justified by the subject of the procurement - the continuous provision of pharmaceutical supplies to the public - and given that the extension is only possible in the case it is possible if the framework amount is not exhausted during the original 48-month period, the determination of the period does not limit the competition, so it is justified in view of the provisions of § 104. (6) of the Civil Code.
