For lots no. 2, 3 and 5 the SUSPENSIVE CLAUSE applies for a period of 3 months, from the date of approval of the procedure report. The contract is valid until 31.12.2026, regardless of the date on which it was signed by both parties. The contracting authority will conclude the contract with the tenderer declared the winner only to the extent that the funds necessary for the purchase will be secured by allocating budget credits for this purpose If, regardless of the reasons, the budget credits will not be allocated, for a period of 6 months from the date of approval of the procedure report, the contracting authority reserves the right to cancel the award procedure, in the conditions where there is no other source of financing, in accordance with the provisions of art. 212 paragraph (1) letter c) of Law no. 98/2016 with subsequent amendments and additions, making it impossible to conclude the purchase contract public.
