Provision of technical support services for Dell EMC Data Protection Suite for VMware backup software for a period of 12 months. 1. The subject of the order is the provision of technical support services for Dell EMC Data backup software Protection Suite for VMware for a period of 12 months. 2. The subject of the contract is described in detail in Chapter II of the SWZ - Description of the subject of the contract. 3. The Ordering Party pursuant to Art. 139 of the Public Procurement Law provides for the reverse order of evaluation of offers, i.e. first examination and evaluation of offers, and then will subjectively qualify the Contractor whose offer was rated the highest in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the proceedings. 4. The Ordering Party is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, further "GDPR". 5. The contractor submits an offer via the eProcurement Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 6. The Ordering Party reserves that in accordance with Art. 257 of the Public Procurement Law, may invalidate the contract award procedure if public funds that the Ordering Party intended to use to finance the order will not be awarded to it. 7.
