Energy Sector Development Project (P148560)Federated States of Micronesia Terms of Reference for a ProcurementAdvisor
January 26, 2015 A. Background In May 2014, the World Bank (WB) Board of Directors approvedthe Energy Sector Development Project, P148560 (The "Project"), a US$14.40 million IDA Grant.
The Project Development Objective is to increase theavailable generation capacity and efficiency of electricity supply in the state power utilities, and to strengthen theplanning andtechnical capacities of the National Government and the state power utilities in the energy sector.The proposed project will include the following threecomponents:A. Component 1: Increasing available generation capacityand efficiency of electricity supply in the state power utilities (IDA US$9.27 million). (a) Carryingout a program of activities designed to increase available generation capacity and efficiency of electricity supply in the StatePower Utilities, such program to include:(i) Acquisitionand installation of new gensets for the Pohnpei Utilities Corporation, Kosrae Utility Authority and Yap State Public ServiceCorporation;(ii) Acquisition and installationof equipment such as capacitor banks, temperature compensateddigital fuel meters and prepaid meters for the Yap State Public Service Corporation.(iii) (A)Acquisition and installation of grid connected photovoltaic generators; and (B) upgrading of the public streetlighting system to amore efficient system, all for the Chuuk Public Utility Corporation.(b) Carrying out of a program of activities designed to improve the technical performance of theState Power Utilities, such program to include capacity building activities, and the development and implementation of operationsand maintenance plans.A. Component 2: National and state energy planning (IDAUS$3.40 million). (a)Preparation of energy master plans for each of the FSM States, including: (i) identifying andprioritizing infrastructure investments in theenergy sector; and (ii) undertaking feasibility studies, and environmental and socialimpact assessments for the priority investments. (b)Development of a national energy sector master plan which will build upon the energy masterplans developed under Component 2(a).A. Component 3: Technical assistance and projectmanagement (IDA US$1.50 million). (a) Carrying out a program of activities designed to build the capacity ofthe Energy Division and the Association of Micronesian Utilities (AMU) for: (i) (1) sector data collection, statistics, and thedevelopment of an information management system, (2) utility benchmarking and (3) implementing the national energy policy; and (ii)broadening dialogue on matters affecting the energy sector, including developing a utilities reform program to improvesustainability of their operations. (b) Carrying out a program of activities designed to enhance the capacity ofthe Energy Divisionfor overall Project coordination, management and monitoring. B. Project ImplementationArrangements The Energy Division in NDRD will implement the project.It has only one staff member, the Assistant Secretary, who will be the project coordinator and focal point.
The project willfinance five full- and part-time specialists (a project implementation support officer, an energy technical specialist, a financialofficer, a procurement advisor, and a safeguards advisor) to strengthen the Division''''s technical capacity. A Project Implementation Manual (PIM)will set out: (i) institutional arrangements for day-to-day execution of the project; (ii) a procurement plan and implementationarrangements; (iii) implementation of safeguard instruments; (iv) budgeting, disbursement and financial management; and (v) projectmonitoring, reporting and evaluation, including implementation of, and compliance with, Bank safeguardpolicies.
The state powerutilities will play a significant role in serving as members of the Steering Committee for theproject to ensure complementaritiesand coordination among the four states and the National Government, and to provide guidance, technical inputs, and data/informationto the consultants hired under the project.
The Energy Division will serve as Chair of the Steering Committee. C. Scope of WorkThe main objective ofthis assignment is to assist the Division of Energy at the NDRD on the procurement of all the goods, services, etc of the EnergySector Development Project (ESDP).The ProcurementAdvisor will be responsible for technical assistance in procuring goods and services, preparing bidding process, biddingdocumentation and contracts conditions. He/she will work with the Implementing Agency and assist them in procurement andprocurement-related training. He/she should be fully familiar with the World Bank procurement procedures, guidelinesetc.Under the overallcoordination and supervision of the Project Coordinator/Manager, the Procurement Advisor will support the Implementing Agency inthe following:A. Procurement of goods, non-consulting services and services of consulting companies and individuals, preparation ofprocurement documentation, selection and evaluation procedures and elaboration of relevant documentation in compliance with the WBprocurement procedures; A. The procurement advisor will assist the IA in the preparation and evaluation of the proposals, and morespecifically:o Ensure the commercial as well as thetechnical clauses of the proposals are of a high quality and are in conformance with the requirements of the latest World Bankprocurement Guidelines.o Review and issue comments on allconsultants'''' packages procured, including those not subject to prior review.o Assist in the review and preparationof the Bank''''sstandard evaluation reports for all documents subject to prior reviewprepared by the IA before their sending to theWorld Bank for "no objection".o Ensure that project costing is inline with the project outcome.o Ensure the timely procurementdocumentation for goods, works, and services (procurement planning) A. The review shall be made with the purpose that the documents are prepared according to the Bank''''s guidelinesand procedures, those applicable covenants in the Grant Agreement, latest bidding forms recommendedby the Bank and follow theestablished best procurement practice; A. Review the latest procurement plan for the project; A. Assist the IA in preparing a procurement time schedule for the implementation of the procurement plan toreflect the major stages in the procurement process (availability of TORs, issue of EOI if required, issuance of RFPs, Bank''''s noobjection dates, submission of evaluation reports (technical and financial), negotiation, drafting and signing contract includingcontract closing dates); A. Verify that all proposed purchases are eligible for financing under thegrant; A. Assist IA to determine the appropriate method to procure each contract; A. Build procurement capacity in the IA and the beneficiaries through hands-ontraining; A. Assist the IA in setting up a record keeping system for all prior review and especially post reviewcontracts; A. Assist the IA in contract management and administration of all signed Contracts under the Grant;and A. Provide procurement training to the IA as required. D. Desired skills, qualification andexperienceA. University degree in finance/engineering/procurement fields;A. Good knowledge and experience of the World Bankprocurement procedures, guidelines and reporting strongly preferred;A. Good knowledge and skills in standard officeapplications (spreadsheets, word processors etc.); A. Experience, as procurement advisor in similarproject in the Pacific region would also be an advantage.A. At least 8-10 years experience on the position ofa procurement advisor for projects financed by international agencies or similar.A. Excellent communication, interpersonal and teamworking skills.A. The adviser must be fluent in English bothverbally and in writing.E. Duration
The part-timeassignment is planned for the period of the project (four years). Provision will be made in the contract for international tripsand for the reimbursement of accommodation and subsistence.
The IA will provide office space, general office supplies and officeequipment including personal computer, laser printer, fax machine and photocopier.It is expected thatthe procurement advisor will work approximately 40 days during the first year of the project, 30 days during the second year and 20days respectively on years three and four.
