Modernization of the automatic technical control system for dams (ASTKZ) - ZZ Włocławek 1The procedure for awarding the public procurement in question is conducted on the basis of the provisions of the Act of September 11, 2019 Public Procurement Law - hereinafter referred to as hereinafter referred to as the "Pzp Act" - and the implementing regulations issued on its basis, in particular the regulation of the Minister of Development, Labor and Technology of December 23, 2020 on subjective means of evidence and other documents or statements which may be requested by the ordering party from the contractor - hereinafter referred to as the "MR Regulation" - in an open tender procedure. 2 Pursuant to Art. 139 of the Public Procurement Law, the Ordering Party will first examine and evaluate the offers, and then make a subjective qualification of the contractor whose the offer will be rated the highest in terms of the lack of grounds for exclusion from the proceedings and meeting the conditions for participation. 3 Pursuant to Art. 257 of the Public Procurement Law, the Ordering Party reserves the right to invalidate the proceedings in question, if the funds that the Ordering Party intended to allocate to finance all or part of the order in question are not awarded to it. In the event of invalidation pursuant to the above-mentioned conditions, Contractors are not entitled to a refund of the costs of participation in proceedings. 4.
