Description of the provision: The object of the contract concerns the execution of the works for the construction of a municipal promotion of 18 official protection housing (HPO) and also includes, jointly, the drafting of the corresponding works project, in the terms defined in the Technical Specifications. The project will be developed on plot 24 located in the partial plan Pla de Tomet, street La Coma, number 3, in the municipality of Bellver de Cerdanya. This action is part of the call for the granting of subsidies for the promotion of housing with official protection under the rental or transfer of use regime for the year 2024, defined by Resolution TER/1799/2024, of May 23, of the Catalan Housing Agency. By being linked to one program with an established execution schedule, the joint contracting of the project development and the execution of the work is justified in order to achieve the objectives of effectiveness, simplification and speed, in accordance with article 2.1.f) of Decree Law 3/2025, of March 4. The contract is classified as a works contract, given that it jointly includes the execution of a work and the drafting of the project, in accordance with articles 13.1.a) and 234 of Law 9/2017, of November 8, on Public Sector Contracts (LCSP). Procedure: For the modification: The modifications provided for in this clause will be processed in accordance with the procedure established in article 191 of the LCSP. They will require a motivated proposal from the Facultative Management of the work, the prior hearing with the contractor for a period of 5 working days, the inspection of the expenditure (if applicable) and the express approval by the contracting body.
