Description
The U.S. Department of Transportation (DOT) has issued Transportation Acquisition Regulation (TAR) Class Deviation (CD) 2025-02 to implement Executive Order (E.O.) 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity.
TAR CD 2025-02 revises clause TAR 1252.232-70, Electronic Submission of Payment Requests, to establish a standard invoice requirement ensuring contractor compliance with E.O. 14173. Effective immediately, all invoices submitted by DOT contractors must include a statement confirming that no unlawful diversity, equity, and inclusion (DEI) initiatives are being carried out under the contract.
Contracting Officers will incorporate revised clause in all new contracts and orders exceeding the micro-purchase threshold. Existing contracts will be modified to include the revised clause at the earliest practicable opportunity.
Note: Even if a contract or order does not require the invoicing clause (TAR 1232.7002), contractors are still required to include the compliance statement with each invoice submission. These actions ensure consistent application of E.O. 14173 across all DOT contracts and payment methods. Contractors are advised to review the updated requirements carefully to avoid delays in invoice approval and payment. If you have any questions, please contact your Contracting Officer.This Class Deviation will be amended or rescinded as necessary if the Federal Acquisition Regulation (FAR) is updated to require contractor compliance with E.O. 14173 through formal representations and certifications within System for Award Management.
