INDIVIDUAL CONSULTANT

Contracting of Consultancy for the Conduct of Training Activities and Document of Technical Recommendations to Strengthen the Negotiation Skills of the Public Prosecutor's Office in the Application of Agreements in Cases of Organized Crime
1. BACKGROUND AND JUSTIFICATION:

The Pan American Foundation for Development in Panama (PADF) within the framework of the PROJECT TO STRENGTHEN THE CAPACITY OF THE JUDICIAL SECTOR TO COMBAT TRANSNATIONAL CRIME, FINANCIAL CRIMES AND CORRUPTION IN PANAMA (CTOC+) seeks the hiring of a legal entity to provide specialized training in negotiation techniques and skills for prosecutors of the Public Ministry of Panama in the application of agreements in cases of organized crime.

2. OBJECTIVE

To prepare prosecutors with the knowledge and skills that every negotiator must understand, develop and internalize in order to achieve the objectives proposed in a negotiation process, such as that of agreements in criminal proceedings.

3. RESPONSIBILITIES OF THE SELECTED LEGAL ENTITY:

a.) Conduct a virtual, asynchronous training program of at least 10 hours for prosecutors of the Public Prosecutor's Office (25 to 35 prosecutors) who carry out investigations against organized crime, so that they have the technical, theoretical, and practical knowledge, skills, and abilities necessary to effectively negotiate agreements to accept charges, as well as effective collaboration on the part of the accused.

b.) Prepare a document or guide for practical application and technical recommendations aimed at ensuring that the prosecutors who consult it have tools that allow them to perform adequately in their processes of negotiating agreements with the accused.

c.) Carry out the writing, grammatical correction of texts and style, and generate an edited document in Word and .pdf formats of the subject matter of consultancy.

d.) Coordinate with the PADF team and attend the work meetings that are convened for the fulfillment of the object of the contract.

4. PLACE(S) OF ASSIGNMENT:

The work will be carried out in Panama City

5. CANDIDATE PROFILE:

Legal person
Higher Education Institution with institutional accreditation in Panama.
Verifiable experience in the design and development of asynchronous virtual trainings.
Verifiable experience in the design and development of specialized training in negotiation techniques/strategies.
Technical and technological capacity to provide virtual or hybrid training programs, preferably on platforms such as Teams or Meet.
It is desirable that he or she has knowledge of negotiation processes (Agreements) of the criminal process.
6. CONTRACTUAL MECHANISM: FIxED PRICE (All applicable Taxes, Fees and other costs must be included in the price proposal.)

Technical work proposal that must contain:

1. Projection of training with Curriculum Mesh with:

thematic units and a brief description of their content.
Methodological description of how the training is carried out.
Evaluation design of input and output evaluation form.
2. Projection of the document or guide, with the methodological description for its construction.

The consultant should provide a pricing model for each deliverable listed in the table above. Payment will be made upon presentation of the deliverable and the respective invoice, to the full satisfaction of PADF.

7. DOCUMENTS OF THE PROPOSAL TO BE INCLUDED:

to. Technical proposal for the development of the objective of numeral 2, taking into account the activities and deliverables described in numeral 6.

b. Include descriptions of similar projects or assignments and at least three certifications, references, and/or contracts executed with a similar purpose.

c. Include your Economic Proposal, together with the breakdown of the preferred daily rate and the justification for it and the information requested in section 6, Contractual mechanism.

8. DURATION OF THE CONTRACT:

Estimated contract start date Sept/27/2024. The contract will last approximately 120 days.

9. PARTICIPATION DATA:

b. Bid validity: 120 days from the submission deadline.

c. Amendments: At any time prior to the deadline for submission of proposals, PADF may, for any reason, amend the Terms of Reference document by means of an amendment that will be published on PADF's website and/or communicated by email.

d. Clarifications: Questions can be sent to proyectoctoc-panama@padf.org. The subject line of the email must contain the number and title of the terms of reference.

10. TERMS AND CONDITIONS

Result of the award

These Terms of Reference (TOR) do not obligate PADF to perform a contract, nor do they commit PADF to pay any costs incurred in the preparation or submission of proposals. In addition, PADF reserves the right to reject any and all offers, if such action is considered to be in the best interest of PADF. PADF, in its sole discretion, will select the winning proposal and is not obligated to share the results of the individual evaluation.

All proprietary information provided by the bidder will be treated as confidential and will not be shared with potential or existing applicants during the bidding process. This includes but is not limited to price quotes, cost proposals, and technical proposals. The results of the PADF assessment are confidential.
