Tender Details

The material scope of the implementation of the subject of the order includes the successive non-cash delivery and transport of light fuel oil for the needs of the Ordering Party's facilities in an estimated amount of approximately 420, 000 liters. The quantity given above constitutes the scope of the Basic Order. Within Basic order The Ordering Party reserves the right to limit the quantitative scope of deliveries indicated in point 4.2 of the ToR by no more than 20%. Due to the limitation of the subject of delivery by the Ordering Party, the Contractor will not be entitled to any claims against the Ordering Party. In such circumstances, the basis for settlement will be the actual amount of heating oil ordered and delivered. The Ordering Party provides for the Option Right in accordance with Art. 441 section 1 of the Act. Under the provided Option Right, the Ordering Party reserves the right to increase the supplies of fuel oil indicated in Basic Order by no more than 5% of the scope of the Basic Order. The option right does not constitute an obligation of the Ordering Party, but only its exclusive right, which may be exercised in the event of unfavorable weather conditions that will result in increased consumption of fuel oil in relation to to the basic procurement or in circumstances where another procedure for awarding a public procurement for the supply of heating oil is prolonged.
