Delivery of gearbox for SA108-008, 010 Delivery of gearbox for SA108-001, 002, 003, 004, 005 1. The subject of the order is the supply of a gearbox generator for SA108 rail buses, the type, description and delivery conditions of which are specified in the Annex. No. 2.1 - 2.2 (Price form) and in Annex No. 4 (Contract template) to the SWZ. 2. The offered parts must: - strictly comply with the requirements specified in Annex No. 2.1 - 2.2 to the SWZ, - be original, brand new, free from defects, meet the relevant requirements quality and requirements of European standards or Polish Standards transposing European standards, as well as unencumbered by the rights of third parties, - meet the requirements specified in the Contract Template. 3. Contractors who: 1) are not subject to exclusion in the circumstances referred to in Art. 108 section 1 of the Public Procurement Act, provided that in the Procedure the contractor is not subject to exclusion in the case referred to in Art. 108 section 1 point 1 letter h of the Public Procurement Law, and in the case referred to in Art. 108 paragraph 1 point 2 of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense specified in Art. 108 section 1 point 1 letter h of the Public Procurement Law, and are not subject to exclusion in the circumstances referred to in: - art. 5k Council Regulation (EU) No. 833/2014 of July 31, 2014 regarding restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine (Journal of Laws EU.
