Tender Details

Delivery of bariatric surgery kits for a period of 24 months 1. The subject of the order is the successive deliveries of bariatric surgery kits of the type and quantity specified in the price form constituting Annex No. 2 to the SWZ and in accordance with the draft provisions of the contract constituting Annex No. 4 to this SWZ. 2. If there is no demand for the product range covered by the subject of the contract, the Ordering Party reserves the right not to order part of the specified product range in the Price Form, constituting Annex No. 1 to the Agreement, subject to paragraph 4. The Contractor is not entitled to any claims for damages or claims based on any other legal basis, to which the Contractor consents. 3.The Ordering Party guarantees that the minimum value orders awarded to the Contractor during the period of validity of the contract in the basic scope will amount to 70% of the value of the Contractor's remuneration in the basic scope, specified in the Price Form constituting Annex No. 1 to the contract. 4. The ordering party is entitled to exercising the option right specified in Art. 441 of the Public Procurement Law (hereinafter referred to as "option law"), i.e.: a quantitative option consisting in the possibility of increasing the quantity of goods covered by the subject of the contract in relation to the quantities specified in Annex No. 1 to contract (price form) in the column "Quantity of sets (basic scope)" with a maximum of specified quantities in Annex No. 1 to the contract (price form) in the column "Number of sets (option right)" Doc...
