Tenders are invited for Customs Police Consultant.

II. Background

The mandate of the Office of the Quartet is to “help the Palestinians as they build the institutions and economy of a viable Palestinian State that is able to take its place as a peaceful and prosperous partner, at peace with Israel and its other neighbors” and more recently to work to enable “significantly greater independence and sovereignty for the Palestinian Authority over its affairs.” More specifically, in the area of rule of law, the office is mandated to “help identify and secure international support in order to address the institutional governance needs of the Palestinian State, focusing as a matter of urgency on the rule of law.”

In June 2015, the OQR transitioned to the Office of the Quartet (OQ), which reports directly to the Quartet Envoys, with a continued focus on the Quartet objectives of Palestinian economic and institutional development and empowerment, which will, in turn, help to advance the Palestinian-Israeli political process towards achieving the two-state solution.

Within OQ, the Rule of Law and Governance unit has worked with the Palestinian Authority (PA), the Government of Israel (GoI), donor countries and other organizations to help the PA strengthen its rule of law capacity, focusing on supporting the Palestinian justice and security sectors, thereby helping ensure stability in the Palestinian territory. For the past eight years, this work has focused on two key areas: (1) expanding the legal and security footprint of the PA and (2) strengthening Palestinian Rule of Law (RoL) institutions.

III. Objectives of Assignment

The consultant will assist the OQ in strengthening the function of the Palestinian Customs Police by reviewing its mandate, laws and regulations, and propose amendments based on International Standards, and best practices that will enhance the PA customs police capacity in combatting smuggling and prevent the entry of spoiled goods and thus protect the Palestinians economy and health.

Scope of Work

The overall objective that OQ seek is a qualitative improvement in the operation of the Palestinian security sector, in a manner that improves the lives of Palestinians and helps ensure stability in the Palestinian territory. The consultant will be responsible in supporting the Security Advisor in strengthening the functioning of the PA Customs Police.

Specifically, the consultant will conduct legal and field researcher that will assist the OQ in the:

· Analysis and recommendations regarding the appropriate mandate and responsibilities of the Customs police based on the international standards and with special focus on the best practices.

· Analysis and recommendations regarding the law regulating the customs police.

· Analysis and recommendations regarding the relationship between the Customs Police and the partner institution and the means of strengthening them.

· Assessment of the urgent logistical needs.

· Analysis and recommendations for deployment of the customs police to Palestinian bonded warehouse to be established at strategic locations in the West Bank to include recommendations for donor support and training.

· Analysis and recommendations regarding the capacity of the Customs Police if deployed to the Allenby and Rafah crossing

VI. Deliverables

A detailed report that will:

a) outline the current mandate governing the Customs Police business and provide recommendation to improve the current law that better reflects the international standards and best practices in that field.

b) Identify the relationship between the Customs Police and the partner institutions and recommendations about the means of strengthening them.

c) Assessment of the urgent logistical needs.

d) Propose the appropriate legal frame work and the best practices that are needed for the deployment of the customs police to Palestinian bonded warehouse to be established at strategic locations in the West Bank to include recommendations for donor support and training.

e) Assess the Customs Police capacity if deployed at Allenby and Rafah crossing and identify its role.

VII. Qualifications and Experience

Education: B.S. in law, Business Administration, economics, or any other related Field.

· Work Experience: 10-15 years of experience in relevant field namely customs.

· Strong knowledge of rule of law in general and the Customs Police Sector.

· Experience in countries or jurisdictions similar to the Palestinian context

Language Requirements: Excellent command of written and spoken English is required, knowledge of Arabic language is a plus.
