Reference Number: ZP / BZP / 224/2018 The subject of the order is the delivery of laboratory equipment for modeling techniques in mining as part of the project "Complex GEO-3EM Energia Ekologia Edukacja "3 Tasks (work stations).

1. Subject of the order is delivery of laboratory equipment for modeling techniques in mining as part of the" GEO-3EM Energia Ecologia Edukacja "project 3 Tasks (workstations):

1.1. Task No. 1 Stand for spatial 3D numerical analysis and processing of non-invasive resultsfieldwork (Workstation with accessories)

Subject of the orders includes: delivery, assembly, commissioning and instruction (understood as a presentation of the use) and validation of operation at the place designated by the Employer. CPV code: 30214000-2 - Workstations. description of the subject of the order can be found in Attachment 3a to the ToR - OPZ.

The detailed scope will be executedthe subject of the order is in the model contract, constituting Annex No. 2a of the Terms of Reference - 2. The deadline for the implementation of the Order is: until 31/10/2018, but not earlier than from 1.9.2018. The deadline depends on the completion of construction works. The ordering party with the contractor will set a detailed timetable for the execution of the subject of the order up to 15 calendar days counted from the date of signing the contract. happinessThe deadlines concerning the date and conditions for the implementation of the subject of the order can be found in the model contract, constituting respectively Annex 2 to the ToR.

1. Contractors, who:

1) can not be excluded from the contract based on art. 24 section 1 points 12-23 and (additionally, the Contracting Authority foresees the exclusion of the Contractor) art. 24 sec. 5 points 1 and 8 uPzp, ie:

1.1. in relation to which it is openthe liquidation, in the system approved by the court in the restructuring proceedings, is intended to satisfy the creditors by liquidation of its assets or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, with the exception of the Contractor, which after the announcementthe bankruptcy arrangement has been concluded by a legally valid court order, if the arrangement does not provide for satisfying the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets pursuant to art. 366 para. 1 of the Act of 28 February 2003 on Bankruptcy Law (Journal of Laws of 2015, item 2333, 978, 1166, 1259 and 1844),

1.2. who violated obligations regarding tax payments, fees-or social security or health insurance premiums, which the Employer is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 point 15, unless the Contractor has made payment of taxes due, fees or social security or health insurance contributions with interest or fines or has concluded a binding agreement regarding the repayment of these amounts.2) meet the conditions for participation in the proceedings regarding: - 2.1. competence or entitlements to conduct a specific professional activity, if it results from separate regulations. The ordering party does not set a specific condition in this respect.

2.2. economic or financial situation. The ordering party does not set a specific condition in this respect.

2.3. technical or professional capacity

The contracting authority does not-determines a specific condition in this respect.

2. (if applicable) The Contractor may, in order to confirm compliance with the conditions referred to in point 1.2) sub-point 2.3. above, where appropriate and in relation to a particular contract, or a part thereof, rely on the technical or professional capacity or financial or economic standing of other entities, regardless of the legal nature-his legal relations with him. The Orderer informs at the same time that the "appropriate situation" referred to above will occur only if the Contractor, which relies on the ability or situation of other entities, proves to the Ordering Party that in fulfilling the order will have the necessary resources of these entities, in particular presenting the commitment of these entities to dedicatedand he has at his disposal the necessary resources to fulfill the order.

The Contracting Authority will assess whether the technical or professional capacity or financial or economic situation of the Contractors provided by other entities allows the contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether or not there are any subject of exclusion, referred to in art. 24 sec.-1 item 13 22 and par. 5 points 1 and 8.

If the technical or professional capacity or economic or financial situation of the entity providing resources does not confirm the Contractor's compliance with the conditions of exclusion or the entities are subject to exclusion, the Employer will request that the Contractor within the time specified by the Employer :

1) replaced this entity with another entityem or entities or

2) has committed to the personal implementation of the relevant part of the order, if it demonstrates technical or professional capacity or financial or economic situation, referred to in point. 1.2), respectively, point 2.3 above.

3. The Awarding Entity may at any stage of the proceedings consider that the Contractor does not have the required capacities if the involvement of technical or professional resourcesh Contractors in other economic undertakings of the Contractor may have a negative impact on the implementation of the order.

Documents list:

1. In order to confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion, the Economic Operator together with the offer should submit the following statements and documents valid as at the date of submitting bids:

1.1. Declaration in the form of a single European dockof the order hereinafter referred to as the EED made in accordance with the standard standard form specified in the European Commission's implementing regulation only in electronic form with a qualified electronic signature (according to Annex 4 to the ToR). The information contained in the EED is a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions of participationu in the proceedings. The Ordering Party submitted the method of ordering in Chapter VI A of the ToR.

1.2. In case of reliance on resources of other entities referred to in art. 22a uPzp Employer in order to assess whether the Contractor, relying on the capacities or the situation of other entities - will have the necessary resources to the extent that allows proper implementation of the public order and assess whether thek joining the Contractor with these entities guarantees real access to their resources, the Ordering Party requests documents (in particular by presenting the commitment of these entities to give him the necessary resources for the needs of the order), which specify in particular: the scope of resources of another entity available to the Contractor, how to use resources of another entity, by the Contractorwhen performing public order and the scope and period of participation of another entity when performing public order.

1.3. Contractor who refers to the resources of other entities referred to in art. 22a uPzp in order to demonstrate the lack of grounds for exclusion and fulfillment to the extent in which their conditions of participation in the proceedings are relied uponregarding these entities

1.4. In the event of joint application by the Contractors, the EAT shall be submitted by each of the Contractors applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the proceedings and no grounds for exclusion.

1. The contractorremains bound by the submitted offer for 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

2. The offer must consist of:

2.1. documents and statements referred to in Chapter VI point 1 of the ToR,

2.2. Contractor's tender form Attachment No. 1 to the ToR (with indication of the password to access the EJF file);

2.3. demonstrating the reservation of information constituting secretthe enterprise in accordance with point 7 below (if applicable);

2.4. power of attorney in accordance with point 3 of this chapter (if applicable).

2.5. description of the subject of the order, technical specification of the equipment offered, allowing to determine compliance with the requirements of the Employer, presented in Appendix No. 3 to the ToR, along with any Information for Contractors, filled out and-signed Annex No. 3 to the Terms of Reference of the OPZ (regarding the appropriately selected Task).

3. Contractor within 3 days from the date of posting on the website information referred to in art. 86 par. 3 uPzp, will provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law Along with the submission of the statement, the Contractorand may provide evidence that connections with another Contractor do not lead to distortion of competition in the procedure for awarding a contract (in the case of joint application for contracting by Contractors, the declaration is submitted by each of the Contractors jointly applying for the order).
