Reconstruction of sand pit with associated infrastructure located on in the Central Sewage Treatment Plant in Koziegłowy. Construction worksworks in the scope of erecting complete construction works or their parts and works in civil and civil engineering.

The subject of the order is the design and reconstruction of sand pit with associated infrastructure located at the Central Sewage Treatment Plant in Koziegłowy.

1. Contractors may participate in the proceedings, orzy are not subject to exclusion from the procurement procedure in the circumstances referred to in art. 24 paragraph 1 point 12 23 Public Procurement Law, art. 24 paragraph 5 points 1, 5 6 and 8 of PPL and meet the conditions for participation in the proceedings, concerning:

a) competence or entitlements to conduct specific professional activities, provided that it results from separate provisions;

b) economic or financial situation;

c) abilitytechnical or professional.

2. In accordance with art. 133 section 4 Public Procurement Law, the contractor is not subject to exclusion in the case referred to in art. 24 paragraph 1 point 13 lit. d Public Procurement Law and in the case referred to in art. 24 paragraph 1 point 14 of the PPL, if the person referred to in this provision has been convicted of an offense listed in art. 24 paragraph 1 point 13 lit. d Pzp

3. To confirm the absence of grounds for exclusion from the postproceedings and to confirm compliance with the conditions for participation in the procedure, the contractor will be required to provide the contracting authority with the following statements and documents, within the deadlines specified in detail in the Specification of Essential Terms of Order (hereinafter: "Terms of Reference"):

a) the contractor`s statement constituting a preliminary confirmation of compliance with the conditions for participation in the procedure specified in the ToR and the lack of podstaw to be excluded, submitted on the form of the single European order document (hereinafter: "EAT"), a specimen of which is laid down in Commission Implementing Regulation (EU) 2016/7

of 5.1.2016 establishing a standard single European order document (OJ EU series L 2016, No. 3, p. 16);

b) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, ifseparate provisions require an entry in the register or records to confirm the absence of grounds for exclusion under Article 24 paragraph 5 point 1 of the Public Procurement Law;

c) a certificate from the competent head of the tax office confirming that the contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids or another document confirming that the contractor has enteredagreements with the relevant tax authority regarding the repayment of these receivables, together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments in installments or withholding in full the execution of the decision of the competent authority;

d) certificate of the appropriate organizational unit of the Insurance Company Social or Agricultural Fundzego Social Insurance or other document confirming that the contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these amounts with interest or fines, if anyhas obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the execution of the decision of the competent authority;

e) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the PPL and regarding conviction for an offense against imprisonment, to the extent specified in art. 24 paragraph 5 points 5 and 6 of the PPL, issued not earliermore than 6 months before the deadline for submission of bids;

d) statement by the contractor regarding the lack of grounds for exclusion referred to in art. 24 paragraph 1 point 15 and 22 of the PPL and in art. 24 paragraph 5 point 5 6 Public Procurement Law (Annex 5 to the ToR).

4. Documents regarding foreign contractors are described in detail in item 7.4. 7.6. SIWZ.

The Employer does not impose specific requirements in the description of compliance with thison the condition of participation in the proceedings.

1. In order to confirm the lack of grounds for exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 item 23 of the PPL, the contractor will be obliged to submit a declaration of belonging or not belonging to the same capital group. The contractor should submit the said statement within 3 days from the date of placing itby the ordering party on the website, the information referred to in art. 86 section 5 Public Procurement Law A model declaration is included in Annex 4 to the ToR.

2. In the procurement procedure, communication between the contracting authority and contractors takes place via the e-Contracting Authority`s platform (https://aquanet.ezamawiacy.pl) and electronic mail to the following email address: (tomasz.jerzak@aquanet.pl), withensuring that the submission of the offer together with EAT takes place only through the e-Ordering Party platform.

3. The Contractor by entering the procedure for the award of this public contract, i.e. by registering or logging in free of charge, in the case of having an account in the e-Ordering Party`s platform, accepts the terms of use of the platform specified in the regulations on the websiteternetowa (https://aquanet.ezamawiacy.pl) and considers it binding.

4. The details of the functioning of the e-Employer platform are described in the Contractor`s User Manual, constituting Annex 9 to the ToR.

5. The offer must be made in electronic form under pain of nullity. The contractor submits the offer on the e-Ordering Party platform.

6. The complete offer must contain:

a) completed formoffer lover (Annex 1 to the ToR), bearing a qualified electronic signature, 1 separate file recommended;

b) a priced Price List, prepared in accordance with the template constituting the attachment to the description of the subject of the order, bearing a qualified electronic signature, 1 separate file recommended;

c) completed by EAT in electronic form with a qualified electronic signature, recommended 1a separate file;

d) in the case of signing the offer by a proxy and in the case of contractors jointly applying for the award of a contract, a power of attorney bearing a qualified electronic signature, 1 separate file recommended for each power of attorney;

e) in the case of relying on the capacity of another entity, the obligation of that entity to giving the contractor the necessary resources for the needsorder completion, bearing a qualified electronic signature, 1 separate file recommended for each commitment.

All of the above electronic documents constituting the offer are recommended to be compressed to one archive file (e.g. 7z).

7. The deadline by which the contractor will be bound by the submitted offer is 60 days. In accordance with art. 85 Public Procurement Law, the period begins with the deadline for submitting bids.

8.Deadline for performance of the contract: up to 15 months from the date of signing the contract.
