- Statement regarding non-compliance in the situations of art. 164 of the Law 98/2016 (the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those having the power of representation, decision or control within him, so as evidenced by the ON certificate issued by the ONRC / constitutive act),

- Statement regarding non-compliance in the situations of art. 165 of Law 98/2016,

- Statement regarding non-compliance in the situations of art. 167 of the Law 98/2016,

- Certificate regarding the lack of debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (state budget and local budget) valid at the moment of presentation, -responsibility for non-compliance with the provisions of art. 59.

Bidder / Candidate / Associate Bidder / Subcontractor / Supportive Third Party who has members of the Board of Directors / Management or Supervisory Body and / or has shareholders or associates persons who are spouse, relative or affinity to grade the second including those who are in commercial relationships, as wellbutter provided for in art. 60 with persons holding decision-making positions within the contracting authority is excluded from the award procedure. DUAE will be filled in - the successful tenderer will present the documents.

All bidders are asked to submit their commitment to the third party with the submission of the DUAE (together with the documents attached to the commitment sent to themto the third party / third party supporters, from which the effective way in which its / their support will materialize), the association agreement and the subcontracting agreement. The supporting documents proving the commitments assumed in the commitments / agreements will be requested only by the successful tenderer at the request of the contracting authority.

The tenderers, the third parties and the subcontractors do notmust be found in the situations provided by art. 164, 165 and 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents demonstrating the fulfillment of the assumed completion of the DUAE are to be presentedat the request of the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the tender evaluation. These documents may be: - - certificates for the absence of overdue debts, regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation,

- as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as the case may be.

Observe the obligation to complete and initiate the IPAE by tenderers / candidates (including Associates / subcontractorsthird / third advocates) as the first proof of non-compliance in exclusion situations and in meeting the capacity requirements. The failure of the DUAE with the offer (including the associate / third party supporter) entails rejecting it as unacceptable. Failure to offer the firm's firm commitment to the offer, resulting in the effective way in which its sustainability will materializeu, as the case may be, of the subcontracting agreement and / or the association agreement leads to a request for clarification of the possible inadequate form of the information contained in the DUAE sections of both the tenderer / candidate and the subcontractor / third supporter, this being necessary to ensure the proper conduct of the award procedure.
