Management of waste with code 19 08 05 from the "Pruszkow" Plant in the maximum amount of 8, 800 Mg with the division into tasks:

Main Site: Pruszkow

Managementand waste with the code 19 08 05, originating from the "Pruszkow" Plant, in the maximum amount of 4 400 Mg.

1. Contractors who can: apply for the order who:

1.1 meet the conditions for participation in the proceedings regarding possession of competences or rights to conduct specific professional activity, provided that this obligation results from separate provisions, i.e.: in the scope of tasks from 1 to 2:

a) they have an actother entry in the register referred to in art. 49 of the Act of 14 December 2012 on waste (Journal of Laws of 2019, item 701) hereinafter referred to as the "Waste Act" in the field of transport of waste with code 19 08 05;

b) have a current decision authorizing processing by recovering waste with the code 19 08 05 issued on the basis of the Waste Act, valid for the entire duration of the contract;

c) submitted forthe authority concerned to amend the decision in accordance with Article 14 paragraph 1 of the Act of 20 July 2018 on the amendment to the Waste Act and some other acts (applies only to Contractors who did not receive a change of decision by the deadline for submission of offers in accordance with the abovementioned article).

1.2 are not subject to exclusion pursuant to art. 24 paragraph 1 item 12 23 of the Public Procurement Law, hereinafter referred to as "Act "or" Pzp "(from the provision of art. 133 para. 4 Pzp) and pursuant to art. 24 paragraph 5 points 1 2, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets does not meet") and the absence of grounds for exclusion will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" in relation to all Contractors who have evillived offers, and

b) documents and statements confirming the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion regarding the Contractor whose tender will be highest rated.

3. The Awarding Entity requests the submission of:

3.1a) At the stage of submitting bids from all Contractors:

a) the offer in accordance with the content of the Bid Form, constituting Annex No. 1 to IDW, Part I of the ToR;

b) uniform eua ropean order document (EAT);

c) power of attorney / power of attorney in accordance with the rules described in IDW. valid as at the date of submitting statements or documents confirming the circumstances referred to in art. 25 paragraph1 Public Procurement Law, i.e. documents referred to in items 6.1b and 6.1d IDW.

3.1c) Each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c IDW.outside the territory of the Republic of Poland, to which the document referred to in item 6.1b (a) IDW applies, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm that the condition referred to in point 1 point 1.1 has been met, the Contractor whose tender will be assessed as the most advantageous will present:

In scope of task 1 to 2:

a) current entry in the register referred to in art. 49 of the Act onwaste in the scope of transport of waste code 19 08 05;

b) the current decision authorizing processing through recovery of waste code 19 08 05, issued on the basis of the Waste Act, valid for the entire duration of the contract;

c) a copy of the confirmation of acceptance by the authority an application to amend the decision in accordance with art. 14 paragraph 1 of the Act of 20 July 2018 amending the Act on waste and someother acts (applies only to Contractors who did not receive a change of decision by the deadline for submission of tenders in accordance with the provisions of the abovementioned article).

5. The Awarding Entity will assess (if applicable) whether the technical or professional capacities made available to the Contractor or their financial or economic situation allow the Contractor to demonstrate compliance with the conditions for participation in the proceedings andda, whether there are grounds for exclusion against this entity, as referred to in art. 24 paragraph 1 item 13 22 of the Act (subject to Article 133 (4) of the Act) and Article 24 paragraph 5 points 1, 4 8 of the Act. The Awarding Entity shall request the submission of relevant documents referred to in item 6.1.b of IDW for these entities.

1. If for a justified reason the Contractor cannot submit the documents required byThe Awarding Entity in point III.1.3 (2) of the notice, the Awarding Entity allows submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 (1.1) of the notice.

2. Refers to point III.1.3, respectively: The Contractor may confirm the fulfillment of the conditions for participation in the procedure, where appropriate and in relation toof the subject contract, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations linking it with it, on the principles set out in IDW (point 6.5 of IDW, subject to the obligation to submit documents indicated therein) .

3. If the Contractor has its registered office or place of residence outside thesethe territory of the Republic of Poland, submits the relevant document or documents in accordance with the principles set out in point 6.6. IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be made in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. The offer together with the required documentsthese should be prepared and submitted in accordance with the principles set out in the notice, IDW and applicable law, including the Regulation of the Minister of Development of 26 July 2016 on the type of documents that the Employer may request from the Contractor in the procurement procedure and Public Procurement Law .

The subject of the contract will be implemented successively, on each request of the Employer, from the date of the contract until December 31, 2020 or until the limit of 4, 400 Mg of waste code 19 08 05 is exhausted, whichever of the above occurs first applies Task No. 1 2.
