Contracting Authorityto respond in a clear and complete manner to all requests for clarification on the 10th day before the deadline for submission of tenders set out in the tender notice, provided that the clarification requests are forwarded 15 days before the date the deadline for submitting bids. Clarifications submitted after this deadline will no longer be taken into account.

Timisoara Municipality-will exclude at any time the procedure for the award of the service contract, any economic operator who is in one of the situations provided in art. 60, 164, 165 and 167 of Law 98/2016 on Public Procurement. Exclusion papers will be applied to associates / subcontractors / third-party supporters, as the case may be.

Way of accomplishment: Under the sanction of rejectionand as unacceptable, each economic operator participating in the awarding procedure, (tenderer, associated tenderer, subcontractor, third party, as the case may be) will present with the offer and DUAE completed according to the provisions of art. 193 par. (1) of Law 98/2016, with information related to their situation.

Will be presented:

(a) statement on non-compliance in potentially generating situationsconflict of interest, as defined in art. 60 of Law no. 98/2016 - by all the participants in the procedure and (b) where appropriate, the firm's firm commitment of the supporting documents accompanied by documents demonstrating the actual manner in which its support, subcontracting and / or association agreement will materialize. The supporting documents proving the fulfillment of asummaries by completing the DUAE shall only be presented at the request of the contracting authority to the tenderer ranked first after applying the award criterion to the admissible tenders.

The supporting documents may be:

1) certificates showing the absence of debts in respect of taxes, or contributions to the consolidated general budget (local budget, budgett state, etc.) at the moment of the presentation;

2) the criminal record of op. economic and members of the administrative, management or supervisory body of that economic operator or those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / Constitutive Act; ) as appropriate, documents demonstratingthat the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

Response to requests will be published in the SICAP in the tender notice; 5) In casewhere the contracting authority requests the submission of certain clarifications / completions for the purpose of checking the compliance of the offer with the required requirements, both the request and the bidder's response shall be transmitted in SICAP only in electronic format, signed with the extended electronic signature. If the bidder's response is posted in SICAP without extended electronic signature, its offerwill be assimilated to the provisions of art. 137 par.
