Quantities and estimated values according to the specification  Requirement 1. Failure to comply with the grounds for exclusion provided for in art. 164, art. 165 and art. 167 of the Law no. 98 / 2016.

Qualifying condition: the economic operator / each member of the association, the subcontractors andthird-party supporters (if any) must prove that they are not in any of the exclusion situations provided for in art. 164, art. 165 and art. 167 of the Law no. 98 / 2016.

Modality of performance: presentation of the DUAE completed by the economic operators participating in the award procedure (associates / third parties / subcontractors) with the related information, with the supporting documents beingit is presented only at the request of the contracting authority and only by the bidders placed on the first two places in the intermediate rankings drawn up at the completion of the evaluation of the tenders

These documents may be: - a fiscal attestation certifying the lack of overdue debts at the time of submission to the state budget and to the state social insurance budgets (health, pensions, unemployment) issued by the General Direction of Public Finances and State Finances Control; the lack of debts will also be evidenced by the secondary headquarters / work points resulting from the ONRC certificate and having a fiscal identification code, - certified on the payment of local taxes and dues issued by the local city hall, the tax certificate certifies the lack of outstanding debts at the momentits deposition; the lack of debts will also be evidenced by the secondary offices / work points resulting from the ONRC certificate and having a fiscal identification code, - the criminal record of the economic operator and the persons empowered in the ONRC certificate of that economic operator as members of the administration, management or supervisory bodyor as persons with power of representation, decision or control, as evidenced by the certifying certificate issued by the ONRC / constitutive act, - the fiscal record of the economic operator, - as the case may be, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 pr❑ Requirement of conflict of interest.

Qualification condition: the economic operator / each member of the association, the subcontractors and the supporting third parties (if any) must prove that they are not in a situation that generates a conflict of interests within or related to the procedure in question, according to art. 59 and 60 din Law no. 98 / 2016.

Means of performance: submission of the completed DUAE and addition of the statement of non-compliance with the situations provided in art. 59-60 of the Law no. 98/2016, with subsequent additions and modifications. This statement will be filed with the DUAE, completed by the economic operator / each member of the association, the subcontractors and third parties (if any).

If there are correspondingly the tenders placed on the first place financial offers with equal prices at the request of the commissionnew offers will be submitted. If equality refers to position 2 of the frame agreement, the item of re-listing will be the price, it can only be upgraded to the level of the price offered by the previous ranked operator. Example: If equality targets position 2, the price could be upgraded to the price of the ranked operator on the 1st place.the reopening financial proposals shall be communicated in the request sent by the evaluation committee.

Taking into consideration the provisions of art. 136 of GD no. 395/2016, regarding the determination of the conditions in which the price elements of an offer are apparently unusually low, the bidder who has submitted the tender in question will be asked for explanations regarding the possibility of fulfilling the contractThe documents justifying the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, by the economic operators ranked in the first two places, in the intermediate rankings, until the end evaluation.

The contracting authority will also respond clearlyto all requests for clarifications / additional information, which were addressed within the deadline stated in the tender notice, on the 10th day before the deadline for submitting bids / applications.
