The bidders, third parties and subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

The manner in which the requirements can be fulfilled: the economic operators participating in the award procedure will be filled in by the economic operators with information related to their situation. With the submission of the DUAE, a Declaration onfailure to comply with the provisions of art. 59 60 of Law 98/2016 - own model F3

The contracting authority will ask the tenderer ranked I, II, III in the intermediate rankings drawn up at the completion of the evaluation of the following bids Documents justifying the accomplishment of the assumed by completing the DUAE:

1) Certificate issued by the Local Public Finance Administration within theNational Agency for Fiscal Administration. The tax certificate regarding the payment of taxes, duties or contributions to the consolidated general budget must certify the absence of overdue debts at the moment of its submission. The manner of fulfillment and the applicability in the procedure: a legible copy signed and stamped by the legal representative with the mention "According to the original";

2) Certificate issued by the Local Taxes and Taxes Directorate. The tax certificate regarding the payment of taxes, taxes, or contributions to the budget must attest to the absence of overdue debts at the time of its submission. The manner of accomplishment and the applicability in the procedure: a legible copy signed and stamped by the legal representative with the mention "According to the original"; 3) the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator, or those having the power of representation, decision or control within that operator, as evidenced by the certifying certificate issued by the ONRC / constitutive act. How to fulfill and apply in the procedure: copy l(4) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in Articles 166, 167, 171 of Law 98 / 2016 on Public Procurement

The persons holding decision-making positions within the Contracting Authority are:

Will be filled in Statement regarding non-compliance with the provisions of art. 59 60 of Law 98/2016 - own model F3.

1) The economic operators submitting the tender must prove a form of registration under the conditionsin the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to carry out the activities covered by the contract. The DUAE will be filled in by the economic operators participating in the award procedure with information related to their situation. Autothe contracting authority shall request the supporting documents proving the fulfillment of the undertaken by completing the DUAE, respectively the certificate issued by the ONRC, the information contained in the certifying certificate must be actual / actual on the date of the presentation and from which it appears that the object of the contract has a correspondent in the CAEN code from Certificate of Finder - for legal personsor, in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted at the request of the contracting authority only by the tenderer ranked I, II and III in the ranking drawn up at the completion of the evaluation of the tenders; 2) Operating notice issued by the Ministry of Health a legible copy according to the original. For 1st place: If it is found that the first ranked offers have equal prices, the contracting authority will request the re-payment in SEAP, in order to divide the bids. Tenders will be loaded into the SEAP by a clear deadline (and communicated to tenderers) by the contracting authority. The lowest bidder will be designated winnerr. If and after re-offerment, the bid prices are equal, then the contracting authority will ask for a new price offer in the SEAP until the tie can be made. If bidders ranked second, they will have equal price offers, they will be asked for new price offers. the bidder ranked I (higher) is not affected in any fbecause the strike demand is firmly and unequivocally mentioned in the second place for which they are reffering. If the third-placed bidders will have equal price offers, they will be asked for new price offers. the bidder ranked second (higher) is not affected in any form, since the penalty requirement is mentioned in fherm and unequivocal third place for which they reffert.
