1) The subject of the contract are timber export services including raw material mass export servicestimber from the areas of the indicated forest districts and delivering to IPI Kwidzyn by forwarding by rail transport.

A detailed description of the subject of the contract is contained in section 3 of the ToR and the draft contract. 2019 item 2140).

As a document confirming the abovementioned condition, the Contractor on requestthe applicant submits:

License for the performance of national road transport in accordance with the Act of 6.9.2001 on road transport.

Contractors who are not subject to exclusion on the grounds specified in art. 24 paragraph 1 of the Public Procurement Law

A list of documents and statements confirming the lack of exclusion is provided in point VI.3 of the notice, additional information.

They ordercy waives the exclusion of the Contractor pursuant to art. 24 paragraph 5 of the Public Procurement Law Act

List of statements or documents confirming the fulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

A. In order to assess compliance with the conditions for participation in the procedure and the lack of grounds for exclusion referred to in art. 24 paragraph 1 point 12 22, the Contractor is obliged to send in the form EAT with the offerand electronic with a qualified electronic signature. Statements of entities submitting an offer / application jointly and entities sharing potential submitted on the JEDZ form should be in the form of an electronic document, signed by a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in art. 22 paragraph 1of the Public Procurement Law

B. The Awarding Entity, before awarding the contract, will call the Contractor whose tender has been rated the highest to submit it within the prescribed period (not shorter than 10 days), valid as at the date of submitting the following statements or documents:

B.1. confirming compliance with the conditions for participation in a technical or professional capacity procedure: indicated in point III.1.3 of the notice inthe scope of license in point III.1.1:

a) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders or requests to participate,

b) the Contractor`s statement that he has not issued a final court judgment or final administrative decisionon arrears with the payment of taxes, fees or social security or health insurance contributions or in the event of the issuance of such a judgment or a decision confirming the payment of such receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these receivables (template Annex 3 to SIWZ),

c) the Contractor`s statement of absenceruling against it as a precautionary measure forbidding public procurement (model Annex 3 to the ToR).

Note: The awarding entity in accordance with art. 24aa section 1 of the Public Procurement Law, it reserves the right to evaluate the offers as the first step, and then examine whether the Contractor whose bid was assessed as the most favorable is not subject to exclusion and meets the conditions for participationin the proceedings.

The term of the offer is 60 days.

1. With the offer form (original) prepared according to Annex 1 of the ToR and the offer cost estimate (Annex 4 to the ToR), in addition to the document from point A, must be submitted:

1) power of attorney to represent, if the offer is submitted by the proxy, if it does not result from an excerpt from the relevant register or from central records and information about business activitycontract,

2) in the case of submitting an offer by a consortium, civil company or natural persons acting jointly, attach to it the original generic power of attorney authorizing the person signing the offer to represent or represent in the proceedings of the bidders and to conclude the contract on the order.
