On the possible requirement of an official decision for the permissibility of the AusuActivity in Austria as well as the obligation under -- 20 and 188 (1) of the Federal Procurement Act 2006 are expressly pointed out. Sections 20 and 188 (1) of the Federal Public Procurement Act 2006 oblige applicants or tenderers who are resident in the territory of another contracting party to the EEA Agreement or in Switzerland and those for the purpose of doing business in Oesterreich have to obtain an official decision concerning their professional qualification, as soon as possible, but in any case before the expiry of the offer period, to initiate a procedure to that effect. For regulated trades (- 94 of the Trade Regulations 1994), reference is made in this connection to -- 373a to 373e of the Trade Regulations 1994.
