Contract for the provision of forestry services XI D.S. Hunedoara 2019

Forestry services are purchased, according to the specifications. Requirement no.1

The bidder, the associated bidder, the subcontractor, the third party supporter must not be found in the situations provided in art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement.

The method of fulfillment: initially, the DUAE will be presented (elaborated according to the standard form existing in the SEAP).

Specifications:

The DUAE form is made available to the bidders in the section LIST OF CARE COMPUTE THE AWARD DOCUMENTATION. In the case of submitting an offer to the association, each associate has the obligation to demonstrate the fulfillment of the requirement. This requirement will also be demonstrated by any subcontractors. In case of the submission of an individual / joint offer technically-professionally supported by third parties / third party supporters, each sponsor has the obligation to demonstrate the fulfillment of the requirementthem.

- the confirmation documents of the associates / subcontractors / third parties will be presented, following the request of the contracting authority, only by the tenderer ranked in the first place in the intermediate ranking. Framing in one or more of the situations provided in art. 164, art. 165 and art. 167 of Law no. 98/2016 regarding the public procurement, attracts the exclusion of the bidderui from the procedure for awarding the contract;

c. The bidder ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers will present, at the request of the contracting authority, the supporting documents proving the fulfillment of the assumed requirements, as follows:

- Certificates confirming the lack of outstanding debts at the time of their presentation, with previval to the payment of taxes, taxes and social insurance contributions to the state budget and to the local budget (for the head office, the secondary offices, as well as the working point / points for which there are payment obligations),

- The criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, or of the oneor which have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act,

- as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided for: art. 166 paragraph (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement,

- other documents editedIf in the country of origin or in the country where the economic operator is established, documents of the type requested are not issued or they do not cover all the situations included in art. 164, art. 165 and art. 167, is accepted any document considered edifiable issued by the competent authorities of the respective country;

In the case of the bidders foreign legal / natural persons documentthey will be sent in the language in which they were issued, in a certified copy "in accordance with the original", signed and stamped by the legal representative, accompanied by an authorized translation of them into Romanian.

For the purposes of the provisions of art. 63 paragraph (1) of Law no. 98/2016 regarding the public procurement, the persons with decision function within the D.S. Hunedoara (including the members of the evaluation committee ofbids) are: Crişan Radu, Breban Daniela, Apolzan Radu, Ghitoaica Izabela, Bogdănescu Maria, Faur Lavinia, Orsa Dan, Anutoiu Marius, Coandă Victor, Pascu Crinela and Ognean Eugen.

DS Hunedoara will reduce the deadline for submitting bids15 days from the date of transmission for publication of the participation notice, in accordance with the provisions of art. 74, para. (3) of Law no. 98/2016. The emergency situation that led to the reduction of the term is presented in chapter IV.4.3. The way of presenting the offer.

The contract can be modified under the conditions of art. 221 of Law no.accepts the contractual clauses included in the contract model from the award documentation.

According to the legal provisions in force, any economic operator has the right to request clarifications regarding the content of the award documentation and implicitly and regarding the mandatory contractual clauses. Thus, if an economic operator considers that certain clauses are in his favor, he will landclarify to the contracting authority clarifications, including their modification, so that, if these clauses will be amended / modified, they will be notified to all interested economic operators, before the deadline for submission of tenders. According to art.137 paragraph (3) letter b) of the GD no.395 / 2016, the offer will be considered non-compliant if it contains proposals to modify the clauses againstthat the contracting authority has established in the award documentation, which are obviously disadvantageous for the latter, and the bidder, although informed about the situation, does not accept the renunciation of the respective clauses.

The contracting authority has the obligation to request the extension of the validity of the offers, in exceptional situations that requiresuch an extension, before the expiry of its validity period. The bidder has the obligation to communicate to the contracting authority whether or not he agrees with the extension of the validity of the offer. The tenderer who does not agree with the extension of the validity period of the offer is considered to have withdrawn his offer without this fact losing the guarantee of participation.the situation in which the tenderer appeals to an association with other operators, third parties or subcontractors, outside the documents expressly requested by the Data Sheet at Cap. III.2 Conditions of participation, with the submission of the DUAE, the commitment of the supporting third party (together with the documents annexed to the commitment, transmitted to it by the supporting third party / third parties, from which to reside will be presentedlte the effective way in which the support will be materialized), the association agreement and the subcontracting agreement. The supporting documents proving those assumed in commitments / agreements will be presented only by the tenderer ranked first in the intermediate ranking at the request of the contracting authority.

For administrative operations (including Art. 63 paragraph (2) of Law no.r. 98/2016), the participating economic operators as bidders, associate bidders, subcontractors or third-party supporters will include in their offer their identification data. is within the provisions of art. 60 of the Law no.98 / 2016. The declarations of non-compliance with the provisions art. 60 of the Law no.98 / 2016 will be presented together with the DUAE.
