Requirement no. 1.
The bidder, the bidder asthe subcontractor, the third supporter must not find himself in the situations stipulated in art. 164, art. 165 and art. 167 of the Law no. 98/2016 on Public Procurement
The way of accomplishment: Initially, the DUAE will be presented (elaborated according to the standard form existing in SEAP).

After the system authentication, details of the DUAE document will be found in the "DUAE Information" section of the "DUAE User Guide" and "DUAE Notification from AADR."
After 18.4.2019, DUAEs in format .xml created with the European Commission application will no longer be open.
Specifications: The DUAE form is available to bidders at the section:(a) in the case of submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. This requirement will also be demonstrated by potential subcontractors. DS Hunedoara will reduce the deadline for submissionto 15 days from the date of submission for publication of the notice of participation, in accordance with the provisions of art. 74 par. The contract will be modified under the conditions of art. 221 of Law no. 98 / 2016.
The tenderer will submit a statementin which it accepts the contractual clauses contained in the contract model in the tender documentation.
According to the legal provisions in force, any economic operator has the right to request clarifications regarding the content of the awarding documentation and, implicitly, on the mandatory contractual clauses. The tenderer who disagrees with the extension of the offer's period of validity is considered to have withdrawn his offer without this losing the part-guaranteeIf the tenderer makes use of an association with other operators, third party supporters or subcontractors, in addition to the documents expressly requested by the Data Sheet at Cap. III.2 Terms of Participation, with the submission of the UAAE, the commitment of the supporting third party (together with the accompanying documents submitted to the third party / third party supporters, from theshowing the actual way in which its / their support will materialize), the association agreement and the subcontracting agreement. The supporting documents proving the ones assumed in the commitments / agreements will be submitted only by the tenderer ranked first in the intermediate classification at the request of the contracting authority.
