Purchase forestry services as specified in the specifications.

Main Site: Loco partida, IX V-th Pelletic. The tenderer, the associated tenderer, the subcontractor, the third supporter must not find themselves in the situations stipulated in art.. 164, Art.165 and Art.167 of the Law no. 98/2016 on Public Procurement.

Mode of accomplishment: the economic operators participating in the award procedure will be filled in with the information related to their situation. The supporting documents proving the fulfillment of the assumed by the DUAE shall be present at the request of the contracting authority only by the tendererranked first in the mid-term ranking of the bid evaluation.

Inclusion in one or more of the situations referred to in art. 164, art. 165 and art. 167 of the Law no. 98/2016 on public procurement, results in the exclusion of the tenderer from the contract award procedure; The bidder placed on the first place in the interim ranking made at the completion of the evaluation of the offers will present, at the request of the authoritythe supporting documents, proving the fulfillment of the assumed requirements, as follows:

- establishing certificates regarding the lack of overdue debts at the time of their deposit, regarding the payment of taxes, taxes and social security contributions to the state budget and to the local budget; as the case may be, documents demonstrating that the economic operatormay benefit from the derogations provided for in: art. 166 paragraph (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - the criminal record of the economic operator, valid on the date of its presentation, - the judicial record, valid at the date of presentation, for the persons who are members of the administration, management or supervisory body of that tenderer or haspower of representation, decision-making or control within it.

1) The communication on the outcome of the procedure will be transmitted to S.E.P. or by using one of the following wayscommunication: fax / email / post;

2) Requests for clarifications formulated by the evaluation commission of the contracting authority will be sent to the bidders only through SEAP; 3) The contracting authority has the right to request the bidders, in exceptional circumstances, the expiration of the period of validity of the offer, the extension of this period. If the period is extendedthe validity of the offer, the period of validity of the guarantee for participation will be extended accordingly. The tenderer has the obligation to communicate to the contracting authority whether or not it agrees with the extension of the period of validity of the offer. The tenderer who disagrees with the extension of the offer's period of validity shall be deemed to have withdrawn his offer, capable of attracting the loss of the participation guarantee; 4) The bidder shall submit a statement accepting the contractual clauses contained in the contract template in the tender documentation to be submitted with the UAAA. If there are objections to the draft contract, namely changes / deletions of the contractual clauses or the addition of new clauses, any proposals for moditermination / completion / removal of contractual clauses will be made in writing through clarification requests. 7) If the economic operator demonstrates compliance with the technical capacity criteria andand if the economic operator intends to subcontract a part (s) of the contract, the DUAE shall also include the required information regarding the subcontractor; ) The contracting authority shall require the tenderer to rank first, after applying the award criterionto present up-to-date supporting documents demonstrating that all the qualification and selection criteria are met, according to the information contained in the DUAE. Where and to the extent that the contracting authority has the possibility to obtain the relevant certificates or information directly by accessing a national database in any Member State, 10) The Provider will, in anticipation of the issuance of the operating permit, make a 5% bail of the authorized wood bundles in order to provide the necessary funds to cover the expenses related to the eventual damages of the nature provided in art. 65 par. (1) of the Law no. 46/2008 Codul Silvic, including for the restoration of the destroyed forest road elements due to the fault of the holder of the operating permit.
