Duree du marche: the duration of the market is fixed at 2 years 1 1

The duration of the market for thermometers is 2 years. Unless a notice is sent by registered letter 3 months before the end of the contract, the contract may be tacitly renewed twice 1 year.

The provisions of this section apply individually:

- to the tenderer submitting an offer for the present march,

- to all tendererswho submit together an offer for the present contract and intend to form a group of economic operators, - to third parties whose capacity is called upon, in accordance with the provisions relating to qualitative selection.

I.6.1 grounds for compulsory exclusion

I.6.1.1 criminal conviction

Cfr. Part III. Section A DUME.

The contracting authority excludes, at someof the procedure, the tenderer being in one of the cases referred to in Article 67 of the Law, having been the subject of a judgment handed down by a judicial authority having the force of res judicata for one of the infringements following:

1) participation in a criminal organization;

2) corruption;

3) fraud;

4) terrorist offenses or terrorist-related offenses;

5) blancapital punishment or financing of terrorism;

6) child labor and other forms of human trafficking;

7) illegal residence of third-country nationals.

The exclusions referred to in points (1) to (6) apply. only for a period of 5 years from the date of judgment. The exclusion referred to in point 6) applies only for a period of 5 years from the end-of the offense.

The exclusion of the candidate also applies when the person sentenced by final judgment is a member of the administrative, management or supervisory body of the candidate or has a power of representation, decision or control. within it.

I.6.1.2 social and fiscal debts

Cfr. Part III. section B of the DUME.

The contracting authority excludes, at any stageof the procedure, the candidate in the case referred to Article 68 of the law, not meeting its obligations of payment of social security contributions and / or tax debts. However, the following situations are not excluded:

1) when the candidate is liable for a debt of less than EUR 3 000;

Or

2) when the candidate is liable for a debt for thethat it has obtained payment deadlines which it strictly respects; Or (3) where the candidate can demonstrate that he has, in respect of a contracting authority or a public undertaking, a claim or claims that are certain, due and free from any commitment to third parties. These claims amount to at least an amount equal to the amount for which he is in default of payment of social debts.The contracting authority, however, gives the opportunity to any economic operator to comply with these social and fiscal obligations during the procurement procedure (see I.6.3 corrective measures) and after having noted for the first time that the candidate or bidder did not meet the requirements. On the basis of this finding, the contracting authorityIssued to the economic operator a period of 5 working days to provide proof of its regularization.

The contracting authority may exclude, at any stage of the procurement procedure, the bidder who is in one of the cases referred to in article 69 of the law:

1) state of bankruptcy, liquidation, cessation of activityit has been reorganized or has made an admission of bankruptcy or is the subject of liquidation or judicial reorganization proceedings, or in any similar situation resulting from proceedings of a similar nature in other national regulations

2) serious professional misconduct;

3) conflict of interest;
