"Note 1: In accordance with the provisions of Article 196, paragraph (2) Law 98/2016, the contracting authority will request the first ranked bidder after applying the award criterionto present up-to-date supporting documents demonstrating that all the qualification and selection criteria are met, according to the information contained in the DUAE.

The following supporting documents will be requested / presented:

1. Establishment certificates for the absence of overdue debts concerning the payment of taxes, contributions and contributions to the general government budgett (local budget, state budget, etc.) at the moment of presentation; The criminal record of the economic operator, namely the criminal record for each of the members of the administrative, management or supervisory body of the economic operator, respectively persons having the power of representation, decision or control within the economic operator, as it results from certifiascertaining evidence issued by the Ministry of Justice - Trade Register Office / Establishing Act of the economic operator; Where appropriate, other documents by which the economic operator demonstrates that he / she falls within exceptional situations which do not result in exclusion from the procedure provided for in Art. 165 par. (3), Art. 166, art. 167 par. (2) and Art. 171 of Law 98 / 2016.

4. By case, anyare other edifying equivalent documents, according to the provisions of art. 168 par. (1) of the Law no. 98 / 2016.

The persons with decision-making positions at the level of the contracting authority, within the meaning of the provisions of art. 60 and art. 167 lit. e) of Law no. 98/2016, are:

Requirement 1. - Annual average turnover The Authority considers it important to establish and apply for a qualification requirement for the average annual turnover in the last 3 years (2015, 2016, 2017), the amount of which shall be at least the estimated value of the contract, ie it must be at least 1, 500, 000.00 RON.

Third Party Support. In the case of the existence of third parties, along with the DUAE form, the tenderer has the obligation to present a firm commitment regarding the financial support of the tenderer, as it is mentioned in the Formation Section Form no. 13.

Association (Form No. 3 and Form No. 4) When submitting a joint tender, along with the DUAE form, the tenderer has the obligation to specifythe Mothers on the Association, as they are mentioned in Section Forms Form no. 3, as well as the Association Agreement, as it is mentioned in Section Forms Form no. 4.

To demonstrate the fulfillment of the minimum turnover requirement, any bidder has the right to: 1. invoke the support of a third party (entity) and use its capabilities to meet whatthe minimum order irrespective of the nature of the legal relations existing between the bidder and the entity whose capabilities it uses under the conditions of art. 182 of the Law no. 98/2016; 2. to participate jointly with other economic operators in the awarding procedure, under art. 53 of Law no. 98/2016

1) If two or more bids are ranked first, with equal scores, departwill be made taking into account the score obtained in the evaluation factors in descending order of their weight. Where equality is maintained, the contracting authority has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal. The new financial proposal will in no way influence the technical proposal, needlesthat remains unchanged. If the equality persists in this situation, the tenderers will be required to submit a new offer to SEAP, up to the bidders' bidding; 2) Confidentiality elements: The bidder will prepare the tender in accordance with the provisions of the awarding documentation and will indicate,, in its contents, which information from the technical proposal and / or proposesfinancial statements are confidential, classified, or protected by an intellectual property right under the applicable law; 3) AC has the right to request in the original any special-purpose document the validity of which is subject to the presentation in this form; interested in participating in the procedure can access the DUAE at https://ec.europa.eu/growth/tools-databases / espd / filter;
